The Cherokee County Board of Commissioners has adopted a 90-day moratorium on rezoning and special use permits in the southwest corner of the county to give staff time to draft guidelines for the fast-developing area.

The moratorium is in effect from Jan. 15 to April 15 for the Ga. 92 corridor and surrounding areas near Acworth, generally as far north as Kellogg Creek Road to the Cobb County line on the south, and as far east as Wade Green Road to the Bartow County line on the west.

The county is working on a small area plan, “the intent of which is to allow continuation of the economic development going on in the area while finding a way to reasonably protect the residential (neighborhoods) and if possible attract retail to the area,” Board Chairman Harry Johnston told commissioners.

Property owners who believe they have “a vested right to the issuance of a special-use permit or rezone” can seek an exemption from the county director of community development, according to the moratorium resolution.
