In a Friday hearing, a judge found probable cause in the misdemeanor battery case against a Fulton County commissioners and sent the case against Marvin Arrington, Jr. over to State Court in Fulton County.

“I’m faced with a situation in which I have written statements and verbal statements made to police that are not consistent with the testimony today,” Cobb County Magistrate Judge Gerald Moore said, in explaining his decision.

Moore heard the case in Fulton County. It was prosecuted by the Douglas County Solicitor, Matthew Krull. Fulton County officials did not participate in the case.

Arrington was accused of pushing his wife, Kristen, to the ground, dragging her along the floor and twisting her arm behind her back until she let go of her husband’s phone in an incident on Sept. 11. A police report said after she let go, he “pushed her, knocking her across the room.”

Kristen Arrington said in the hearing that she was only dragged because she held on to her husband’s belt as he tried to leave the house.

“He was walking away from me,” she said. “I was using the belt as leverage to hold him back. … I got drug across the floor as a result.”

Arrington, who was elected to the board of commissioners in 2014, is out on bond. The couple entered the courtroom together, holding hands.
