A recent case has residents and lawmakers grumbling over a state law that allows convicted sex offenders to drive ice cream trucks in Texas.

In the west Texas town of Odessa, a registered sex offender named Ralph Romo drove an ice cream truck for two days before the company he was working for, Frosty Treats, conducted a background check.

The company discovered that Romo had been registered as a sex offender for a decade, according to CBS 7.

Further investigation of his background was prompted by a concerned parent who saw Romo taking photos near the local high school.

According to state law, as long as a registered sex offender has completed parole, the person can operate an ice cream truck. Sex offenders in Texas are forbidden from driving school buses and taxis.

In this case, Romo failed to report his new job to the local police department, as is required of registered sex offenders, so he was arrested and is being held at the Ector County Jail on $25,000 bond.
