A 2-year-old girl, very seriously injured when a family member hit her in the driveway of their Rockingham Lane home in Cherokee County Sunday, has died.
Marilynd Duty was playing in the driveway around noon when Mario Viera, 36, of Woodstock, started to leave the residence in a Ford Conversion Van.
Viera stopped after running over the child and 911 was called, said Howard Baker, Cherokee County Sheriff's spokesman.
The girl was rushed to WellStar Kennestone Hospital where she later died.
The child, along with two of her siblings, has been residing at the residence with guardians, Cheryl and Sid Anderson since August, said police.
Viera is the Andersons' son-in-law.
The Andersons, who know the children's parents, were granted legal guardianship of the children the Cherokee County Probate Court earlier this year.
Further investigation is underway by the Cherokee Sheriff’s Office Criminal Investigation Division and Traffic Unit, said Baker. But no charges have been filed at this time.
