Judged fairly, pay packages cost us dearly

The president of the State Bar of Georgia, Gerald M. Edenfield of Statesboro, writes to express the extreme disappointment of lawyers that Gov. Sonny Perdue vetoed “the first substantial salary increase” for judges in nine years.

Lawyers studied the issues and concluded that judges’ pay should be raised by 20 percent, which was reduced to 5 percent, plus cost-of-living adjustments, by the Legislature.

But Perdue rejected the popular option and did something responsible and revolutionary, setting a precedent that every future governor should follow — and not just for judges. He looked at the whole compensation package. He explained in his veto message.

“I have consistently expressed concern with raising judicial officers’ salaries without tackling the well-above-market retirement benefits.” What’s more, he said, a review that he’d commissioned by employee-benefits consultants at New York-based Mercer LLC finds judicial pay to be “in line with competitor states and various counsel.”

In Georgia, Supreme Court justices earn $167,210. Their counterparts in Florida, North and South Carolina, Tennessee, Texas and Virginia average $153,356, according to the study. Superior Court judges are paid $120,252 by the state, but, with one exception — the Alapaha circuit, which covers five counties extending north from the Okefonokee Swamp — counties supplement their pay. The average is $35,160.

My specific interest here is not what judges make. Whether they’re underpaid or overpaid is entirely dependent on the quality of an individual’s service. The fact is, and has always been, that salaries are public record and the applicant pool is always full. When bad judges rise to the bench, far more often than not, it’s because a governor put them there at the expense of better-qualified applicants.

“We are looking for the best and the brightest of the public minded,” said Perdue this week, “not the best and the brightest that money can buy.” This particular veto and the affected group are the backdrop, really, for a far more important story.

Those who’ve followed the latest accounts of Atlanta’s budget woes know that city officials blame this year’s problems on high health care and pension costs, exacerbated by a short-sighted decision to buy off unruly employees with future money. In 2001, it adopted a formula change for computing police and fire benefits that was foolish, dramatically increasing long-term costs.

Business and government — especially government, because it can levy taxes to cover its recklessness — should therefore look not just to pay but to the cost of benefits, current and future. That’s what Perdue did on the proposed judicial pay increase. The Mercer review “confirmed that the judiciary’s retirement benefits are far above market average.”

When Mercer compared the total compensation of judges to peers in the private sector, it found that they ranked fifth of 94 in the peer group on total benefits — in large part because benefits are backloaded, as was the custom for public employees. At age 60, judges with 16 years’ service can retire with two-thirds of their highest salaries; at 24 years, the maximum, it would be three-fourths. For appellate court judges, that’s about $9,200 per month after 16 years on the bench.

Perdue’s begun a process to modernize the public-employee compensation system. Recognizing that few now spend an entire career with one employer, he’s begun to look at the whole compensation package. The aim is to raise salaries early by moving some of that backloaded compensation forward. The best solution would be to move from defined-benefit to defined-contribution plans that would allow workers to take their full retirement benefits with them to new jobs.

For taxpayers the marvelous side effect of changing the way we compensate public employees could be to remove the temptation by employees to game the retirement system and by politicians to corrupt it. That’s been the pattern for decades.

On this issue, Perdue is cutting-edge. He could save Georgia from Atlanta’s financial fate.

“This will put us in a position to have action next year,” says David Doniger, director of the climate center at the Natural Resources Defense Council, a supporter of the bill. “We expect in the Senate that the 60-vote rule will be applied. That’s a hard one to get over.”

Raising prices to FORCE us to a clean economy even though no one has any idea what that is.

But hey, it’s your money not their’s, so why should they worry over the minor details, like having a plan and all that.

Well, I say let these judges pass the plate in court, the way preachers do, if they want to get paid and then retire. Or maybe sell tickets to court. Don’t use my tax money to help them. I’m with jbmlaw. Taxes is just thieving. Old Sonny is right, just the way he was right when he come up with the GA Water Plan. Which was praying for rain. He always uses the cheapest way to solve a problem.

Anyhow, if the judges don’t like the money let them quit. We have way too many lawyers to take their place. We got too many lawyers period. There’s so many alot of them don’t even practice law. They do bankruptcies and set up debt collection firms and work for insurance cos. and become politicans and just about everything else. And when they don’t have nothing else to do they blog. We got lawyers coming out the ears like fleas on a coon dog.

Anyway, if we got rid of the judges we have we could have some Justice and Law and Order. Instead of a bunch of people trying to figure out ways to say a guy is not guilty or let them out of jail or say we can’t put the needle to them. We need people that will hop into a judges seat and say guilty and then set the Death Penalty all within the hour.

Being good at the law don’t mean you will be a good judge. We could look at some people that flunked out of law school and offer them the job. We wouldn’t notice much diffrence. I say set the pay at 20,000 bucks a year for a judge and let him take a little money on the side from the lawyers in court. I ain’t looking. Just anything to keep from raising taxes.

Finally, the federal court is forcing Bush and his cronies to release the report on the environment that they wanted so desperately to keep out of the hands of the public. Good show — late, but good.

It looks like gas is going to hit a national average of $4/gal real soon. The sooner, the better. It should even go higher if that’s what it takes to stimulate alternatives such as building something other than SUVs. Now let’s keep going and get the people living closer to work, shorter work weeks, more bus routes, rail, 50 mpg cars, etc. Who will care if gas is at even $10/gal.

Killing is wrong. People who kill need to be punished. Let’s not become killers in order to effect that punishment. Bring back Alcatraz except place it somewhere more remote — surrounded by mines, sharks, etc.

It’s time to start moving out of Iraq. Our efforts there will not lead to the Utopian democracy that Bush has visions of creating. We know what will happen because we helped to do the same thing to the Soviets when they invaded Afghanistan. Bush needs stop abusing the people and (former) wealth of the US. If this war were truly worth the effort, then a draft would have already been implemented and our “leader’s” children would be over seas fighting alongside everyone else.

Now that we know that the average American is spending the “stimulus check on every-day needs such as food, medicine, and clothes, what will this Republican administration think of next. So far, Wal-Mart is the only business getting stimulated — stimulated selling us pants from Pakistan and pills from China. Exactly whose economy is getting stimulated.

I could retire comfortably on $9200/month taken from the pockets of hard-working taxpayers. Couldn’t you, Jim? I’ll bet it wouldn’t be that hard to convince yourself that you even earned it. After all, it’s such a small price to pay for 16 years of listening to the incessant whining and moaning and whatever of those brought before you, the judge. But, wasn’t it also the Republicans that got us to this point in the first place. I seem to recall the Republicans touting that all we needed to do was get the compensations of our fine outstanding public servants increased sufficiently and everything would be just great. I know, let’s give them all credit cards and promise to look the other way — even if they happen to be making purchases at the local bar or liquor store. Now, Sunny is singing in the rain — the blues, that is. Sunny should lead by example. He should start by paying taxes on some land that he bought. Then, he should take a cut in his pay and his benefits. Take the lead, Sunny, and quit preying on those that can least afford it. What do you think, Jim?

Sonny is right on this one. $167k is a lot of money and so is $120k. Leah Sears must have been feeling particularly bold to tell the Legislature that judges preferred a 20% raise but would take a 10% one if necessary. Judges seem to be doing just fine. I’m sure everyone in Atlanta has seen Anne Barnes zipping around in her $50k Infinity by now.

Many lawyers in the state are looking at the salaries first year associates are making at the big law firms as the new standard. I think it’s now up to $145k in Atlanta. But these salaries are probably not sustainable. Times are tough and clients don’t really care to subsidize a first year associate’s 7 series nowadays. I think Sonnenschein Nath & Rosenthal and Holland & Knight have had recent layoffs in fact.

The question in my mind is why is the President of the State Bar so fixated on judicial salaries? Shouldn’t he be concerned with salaries for all members of the State Bar? What about other lawyers employed by the state, who earn salaries significantly lower than the $78,310 national average for state employed lawyers? Or prosecutors and staff attorneys employed by local governments? Or, for that matter, what about the arguably inappropriate $145k salary for a first year associate? Those firms are furious about these salaries and eating those associates alive as a consequence with insane hours and pressures. These associates scramble for the jobs and then scramble for the door a few years later. And in the process few get proper mentoring about law’s bedrock values. Instead how much you earn becomes the sole criteria for judging professional ability.

UN’s Iraq mandate expires in July 09? I didn’t know that.

That is very important news 2B ignorant about when I blogged so long and hard about the future of our occupation! I apologize 4 my arrogance and my nonsense about Iraq. A little knowledge is a dangerous thing: it’s inversely proportional to the degree of stupidity, dont you think?

I’m definitely going to have to read more. Do your homework, people, then blog. Otherwise, you’ll end up blogging like me.

Also, I admit that I never heard of superdelegates until last fall. Florida’s democrats voted unanimously to violate DNC rules about early primaries because the GOP attached a paper trail ballot rider to the GOP legislation. They calculated that the consequences for violating their own party’s rules were far less than the chaos that would descend on the DNC as voters became aware of the undue influence superdelegate’s weild.

Also, in their defense, Florida’s legislature believes that their state’s diverse demography is a microcosm of the USA. They feel that their polls should be like a national stamp of approval.

The UN’s global stamp of approval expires next summer. We either must get an extension, or like Florida, Iraq’s liberals must vote against their own interests to allow the US to stay.

We need to advance the national discussion beyond the conservative’s theo-jingoism and disown Bushspeak. McCain’s only chance is to admonish Bush’s spin on Iraq. He’s got to bloody a nose, and blacken a couple of eyes. Or else he’s finished.

The Democrat’s insistence that we leave is more understandable when you consider that the UN mandate expires next summer. Why didn’t the country know that? Doesn’t that weaken the poll-pleasing campaign pledge to get the troops out? We had to leave anyway! What kind of deal can we offer the Iraqi Parliament liberals to convince them to let us stay? This seems to be the crux of our occupation now. I didn’t know, did you? And notice how I use the term Iraqi Liberals. I dont know if their conservative or liberal. Maybe it’s up to the observer. I know nothing about Iraq’s Parliament. Do you?

Yet a public school teacher, whether with a B.S. or a PhD, CANNOT retire in 16 years (unless over a certain age) and if they did they would get 32% of avg 2 yrs greatest salary! 32% of not much is …. not much (about $1200 per month?). A teacher with 30 years in gets (gasp) 60% of that salary. Why the unequal treatment? Is the worth of teachers that much less? Figures out to less than $3000 per month for a teacher with a BS and 30 years experience, I believe. With a PhD and 30 years it figures to less than $5000 per month. And I can tell you that much more is expected of teachers (the old water into wine thing.)

So it is not ALL government employees who have the “great benefits” backloaded. Some don’t get them from the front OR the back.

Good morning all. Judges are fungible. I would suggest a salary around $125,000 - $150,000, with no retirement plan other than a conventional employer-matching 401-k. You want to set the salary low enough that nobody feels a desire to stay too long. The worst problem in the judiciary is the imperious wise man who believes only he has the capacity to judge; we need a revolving door, run come fresh blood through regularly. $125k is enough for anyone to live comfortably. Maybe more to the point, why should lawyers have any more input into setting judge salaries than, say, bricklayers? I believe you could set the salary at $75k and you would never lack competent judicial candidates, although they may be less experienced than the old men sitting now.

AJCM brought up an excellent example of gaping mouth government “health care” employees who are about as sharp as a sack of wet RATs. Well, here’s another example of the beloved government health care institution, and it comes as no surprise as usual, coming from (Oh) Canada.

Feel like sitting on a cot for five f*** days while the government apes under Hillary/Obama scratch their @sses waiting for instructions?

Mark Degasperis was furious his mother spent five days on a stretcher at Toronto Western Hospital waiting for a room with 25 patients ahead of her — until the Toronto Sun made a call and she was suddenly moved to a room yesterday.

Keep in mind that only 16% of this nation has no health care PLAN. EVERYONE in this nation has “health care.” But leave it to the disease of neo-Stalinist liberalism to want to F up what is working for 84% of the nation - not that our current health care is 100% perfect. But it beats the HELL out of what Canada has under “universal” health “care.”

Oh, I love this nice summertime weather. I also love hearing about our governor acting like a real conservative. Let’s encourage him LOUDLY and maybe others will get the “fever” of economy. Sounds like judges need to manage with a little less, a lot less.

On another subject, I was reading in the local newspaper some of the scholarships won by outstanding high school graduates. Not only have these students made excellent grades, almost all of them have done a lot of volunteer work in all kinds of ways. Some even started in elementary school. They seem to have the ability to reach out to others in their character. That gives me great hope for the future of this country.

I also hope all of these graduates, some of whom are going to prestigious out of state schools,will return to enrich Georgia as the ethical professionals they wish to become.

EBENSBURG, Pa. (AP) - Members of a small Amish community in western Pennsylvania have to decide by tomorrow whether to challenge a state order over their school’s outhouses. The school sits on Andy Swartzentruber’s farm 70 miles east of Pittsburgh. A state judge has ruled that he and the school are in violation of the state sewage disposal law.

You know, it is an absolute miracle that the Amish have survived in this nation as long as they have. Now I don’t know if that four star movie “Witness” had anything to do with it, but it seems to me the feds have pretty much left the Amish alone.

That said, the state government of PA obviously has different ideas. I wonder, would this same state government have no problems using PA taxpayer dollars to put Muslim FOOT BATHS in airports like Missour[uh] did?

At one point in the Playboy piece titled “Porn-O-Rama!” Franken called the Internet a “terrific learning tool,” writing that his 12-year-old son was able to use it for a sixth-grade report on bestiality.

How liberal of him. Do you want your kids at the 6th grade level learning about screwing a horse? Call me crazy, but I find that unequivocally DISGUSTING.

But leave it to the disease of liberalism (which NEVER knows when enough is ENOUGH) to find this “tolerant.” GOD how disgusting. It’s almost incomprehensible - no it IS incomprehensible - but you have to remember that this is merely another example of the disease of liberalism.

Take the Auschwitz flub, where Mr. Obama erroneously claimed last weekend in New Mexico that his uncle helped liberate the Nazi concentration camp. Reporters noted Mr. Obama’s revised claim, that it was his great uncle who helped liberate Buchenwald. They largely downplayed the error. Yet in another, earlier gaffe back in 2002, Mr. Obama claimed his grandfather knew U.S. troops who liberated Auschwitz and Treblinka – even though only Russian troops entered those concentration camps.

This guy is a complete dunce which makes me think he’s something of a Manchurian candidate for the hard left. He’s the cult fooled though.

According to Gallup’s May 12-25 tracking polling of 11,000 registered voters in all 50 states plus Washington, D.C., Sen. Clinton is running stronger against Sen. McCain in the 20 states where she can claim popular-vote victory in the primaries and caucuses. In contrast, Sen. Obama runs no better against Sen. McCain than does Sen. Clinton in the 28 states plus D.C. where he has prevailed. “On this basis,” Gallup concludes: “Clinton appears to have the stronger chance of capitalizing on her primary strengths in the general election.”

The 20 states, Gallup points out, not only encompass more than 60% of the nation’s voters, but “represent more than 300 Electoral College votes while Obama’s 28 states and the District of Columbia represent only 224 Electoral College votes.” Sen. Clinton leads Sen. McCain in these 20 states by seven points (50%-43%), while Sens. Obama and McCain are pretty much tied. But in the 26 states plus D.C. that Sen. Most unions have some ability to push the issues on behalf of their members. Georgia does not allow ANY teachers’ union to do anything more than meekly ask, as per state law, and then wag the tail appreciatively when scraps are thrown.

In some other states you have heard of the schools being closed due to teacher strikes over pay, but not in Georgia.

What Moron Jim doesn’t tell you is that the benefits are part of an employees total compensation. If I was a lawyer, I would make a lot more money working for a law firm than as a judge in a backward, inbred, redneck state. The reason people go into ‘public service’ is because they give up a lot in salary to get a little more in benefits.

I find is typical Rethuglicon boot-licker hypocrisy that they want to reduce the cost of government yet demand immediate service when they walk in to the tag office or to get a drivers license. You rail about the ‘idiots’ that run government yet don’t want to pay a decent wage for quality workers. I’d keep in mind the old saying: You get what you pay for. If you don’t want to pay very much, that’s exactly what you will get. The Laughing Fatman’s vetoing a pay increase for judges is short-sighted even for him. It just will encourage them to stay in private practice. Then who will run the courts and hold trials? This could mean that people are released because they don’t get a speedy trial.

When you vote Rethuglicon, you vote against your own best interests. And the LFMs veto of judges pay raises is living proof.

So what if the surge is successful? The ‘03 invasion was successful. For two seconds. The conservative lunatic fringe is always half-right. And conservatism deserved all the glory and the power that such an amazing geo-political feat deserved. He decided the Chinese would not enter the Korean Conflict if he drove the commies to the chinese border. He decided that he was some sort of super-statesman who could divine the reaction of china’s new government led by a certain Chairman Mao. Then, when he was proved to be qualified for the military rank of potato peeler when faced with international diplomacy, he urged Truman to nuke china. The beginning of the cold war was very hot. Macarthur was a mad man, and that craziness served him very well at the tactical level, but enlarge the theatre and suddenly we’ve got gomer pyle and world war three, and the very very end. Nuke china indeed. How close we came, people. How close we came.

This is the conservative philosophy. The short term. The military industrial complex’s strategic vision for it’s stockholders.

Has anyone else noticed that when liberal demobats are the majority of the posters during the weekdays that no Conservative Republican ever complains? As usual however, when the tables are turned, the usual suspect bedwetter liberal half wits wail, thrash, and gnash teeth. Well that’s just a damn crying shame, ain’t it?

Anyway, moving forward…

The economy consumes the nightly newscasts. Broadcast networks report that America’s finances are “like a house of cards.” ABC, CBS and NBC even hyped similarities to the Great Depression more than 40 times in the first four months of 2008. But that parallel doesn’t hold up, especially when analyzing the news of that era. In fact, daily coverage of the 1929 stock market crash strongly emphasized the positive side of events. The New York Times that year summed up a six-day Dow Jones loss of 30 percent as: “the market quickly regained its poise and stability.” In 2008, coverage has taken the opposite tone, even though the Dow dropped just 1/100th of 1 percent in the days after the collapse of investment bank Bear Stearns. ABC found a dark cloud for every silver lining, saying: “And everywhere you look, it’s bad news.” On network news, that statement was accurate.

Gee, you don’t think our beloved lame stream media complex would have an agenda or anything, right? I mean, the demobats have been running congress for close to a year and a half now, and the jackasses in the slime media still act as though Bush is pulling all the strings - no, check that - CHENEY is pulling all the strings in Washington (Rove is gone, and don’t you just know the half wits on the left are just beside themselves in missing him).

In any event, I have more and make a lot more money today than I did when Clinton was president. Gas prices have little affect on me, but I do wonder exactly what in the hell Pelosi & Reid Co. have planned since it’s been two years since those moonbats promised to “curb” gas prices back when the average pump price was a stunning $2.40/gallon.

For those interested, here’s a nice graph that shows gas prices. Check out the actual inflation adjusted cost. You’ll note the line is a lot more flat that the raw price data.

You think the lame stream media complex would show you that or even TELL you about that? Nah, there job is to scare everyone into REALLY putting this nation into a recession to put demobats completely in charge of Washington (God help us). For the half wits out there, a “recession” is defined as two or more consecutive quarters of negative growth. We have not had that yet, but most d******* in this nation who get their “news” from said lame stream media outlets wouldn’t know that little left out detail of all this recession/depression talk. That reminds me, you think any of those asshats in the lame stream media would interview a REAL depression survivor for comparison sake and how “bad off” we are as a nation today? Oh hell no.

The Senate version was drafted by two Vietnam veterans, Jim Webb, Democrat of Virginia, and Chuck Hagel, Republican of Nebraska. They argue that benefits paid under the existing G.I. Bill have fallen far behind the rising costs of college. Their bill would pay full tuition and other expenses at a four-year public university for veterans who served in the military for at least three years since 9/11.

Anyone with an IQ above room temperature and anyone with a basic reading comprehension capability (that of course immediately rules out your typical New York Slimes reader - of which our own beloved Atlanta Urinal Constipation loves to reprint “news” from frequently) knows that both Bush and McCain want to do everything possible for those who serve in our military.

I mean, come on. You didn’t expect that bird cage liner snotrag of liberalism (I’m talking the Slimes here, not the Constipation for the moment) to mention all those additional millions of “military benefits” tacked on to the GI Bill such as extending unemployment benefits now, did you? Hard to believe that it has been a year since hundreds of thousands took to the streets in Venezuela to protest President Hugo Chavez, his so-called socialist reforms and his shutdown of RCTV. Scooters and mopeds are growing in popularity among commuters, allowing them to keep their cars in the garage to help reduce emissions for the quick trips around town. Nationally, fuel-sipping scooters are surging in popularity from 12,000 sold in 1997 as compared to 131,000 in 2007, according to statistics compiled by the Motorcycle Industry Council in Irvine, Calif. “It seems like when we’ve seen these recent spikes in fuel prices, that there has been a correlation in sales,” said Mike Mount, a spokesman for the industry group. For some people, bicycling takes too long or leaves work clothes crumpled.

Compare that to, say, $.18 for every dollar made by a grocery store or retail store. Is congress doing anything about grocery store and retail store profits? Oh hell no.

It only took a month but the New York Times finally got around to almost saying they were wrong about the United States using biological weapons against some other country/ies. They do imply that the evidence just may still be hidden out there, though.

An article on May 4 about black liberation theology and the debate surrounding the Rev. Jeremiah A. Wright Jr, Senator Barack Obama’s former minister, erroneously confirmed a statement by Mr. Wright that the United States has used biological weapons against other countries. There is no evidence that the United States ever did so.

Gawd. Anyone remember having to drive 55 on interstates? Well, some liberal twinkletoed liberals that ooze of liberalism think it may be a good idea again to “save gas.” That is, until a website starts investigating the facts:

The U.S. Department of Energy says gas mileage plummets above 60 mph and says every 5 mph above that speed is akin to paying an additional $0.20 per gallon for gas. But the American Heritage Foundation claims 12 years of 55 mph speed limits cut fuel consumption by just 1 percent. After Congress repealed the National Maximum Speed Law and 33 states raised their speed limits, the Cato Institute said traffic deaths dropped to a record low.

You think your average idiot Democrat voter would go to lengths to research facts for him or herself?

Anybody could have looked up on top of what was left of the tower crane and seen that the turntable was not attached to the mast. But the government officials went babbling on about the turntable failing. It did not. How, pray tell, does this help the immediate need to inspect other tower cranes for the same fault if you do not properly identify the correct fault? How exactly will this save lives?

Now we get to the larger point that I was trying to make, don’t jump to conclusions because I am going to use wit and sarcasm in the following, you are required to think some.

I know that all of the climatologists and weather experts that populate the halls of the United States Congress will be able to properly identify what is causing the temperatures to slightly fluctuate and will implement the correct solution to the “problem.”

NEW ORLEANS (AP) — Despite more than $22 million in repairs, a levee that broke with catastrophic effect during Hurricane Katrina is leaking again because of the mushy ground on which New Orleans was built, raising serious questions about the reliability of the city’s flood defenses.

Outside engineering experts who have studied the project told The Associated Press that the type of seepage spotted at the 17th Street Canal in the Lakeview neighborhood afflicts other New Orleans levees, too, and could cause some of them to collapse during a storm.

The Army Corps of Engineers has spent about $4 billion so far of the $14 billion set aside by Congress to repair and upgrade the metropolitan area’s hundreds of miles of levees by 2011. Some outside experts said the leak could mean that billions more will be needed and that some of the work already completed may need to be redone.

Now Slime, err, Time magazine is comparing Obama to Carter. Yeah, that’s JUST what in the hell this nation needs at this point in time - another Jimmuh Cartuh. Of the two likely nominees this year, Obama is closest to Carter in background and policy leanings. The parallels between his campaign so far and the one Carter ran in 1976 are striking. Like Carter, Obama had little national experience when he started to run. Neither was given much chance of winning the nomination.
