Block cronyism and pension double-dipping

At the age of 58, Fulton County Superior Court Clerk Juanita Hicks retired with a pension payout equal to 88 percent of her annual salary of $143,372. At the behest of her hand-picked successor, she promptly returned to work as a $55-per-hour consultant.
This is an incredibly stupid system — gamed, mined and exploited relentlessly by well-connected public employees. It’s stupid in design, stupid in operation.
That the governor and the General Assembly allow to go on should outrage every working stiff in Georgia.
One outrage is that Hicks and most, if not all, of the other Superior Court clerks in Georgia, as well as sheriffs and other public officials, are allowed to double-dip daily, to count every day on the job for credit in at least two publicly financed pension systems.
Taxpayers directly provide one, with a generous benefit formula that gives Hicks an annual payout of $105,588 per year. And they indirectly provide another. Fees of $1.75 each from fines, $1 from every civil case, and 50-cents from every real-estate filing are collected and paid into a separate retirement fund for the clerk and deputy.
That’s a kitty, separate and distinct from the county employees retirement fund, that provides a minimum of $1,700 per month to clerks who have 12 years of service and have reached the age of 55.
The first outrage, then, is that Georgia allows double-dipping — and, furthermore, legislatures have for decades been compliant in continuing the abuse. There’s an in-the-shadows system in play for the Superior Court Clerks’ Retirement Fund of Georgia and for similar special-beneficiary funds that keeps them ever from rising to the public’s radar.
The system is to raise fees until the pot builds up and then to get legislative agreement to raise payouts because doing so will require no new or higher fees. The Legislature compliantly nods and rubber-stamps the hike. It’s a never-ending, never-examined cycle.
The key reason is that beneficiaries such as Superior Court clerks are politicians with their own voting blocs. Easier to pay them off with double-dipping pension systems than to take them on and risk their ire. So nobody does.
The Legislature needs to reform the system by closing the single-beneficiary pension systems where those on the public payroll are eligible for inclusion in broader public retirement systems. Close them all to new clerks and phase them out. It’s absurd for taxpayers to fund two or more pension plans for the same day of work.
The second and easier legislative fix prompted by the Hicks revelations is to end the practice of allowing Superior Court clerks to appoint their successors. It’s a system that invites cronyism and the kind of sweetheart transaction evident in the appointment of Hicks to the $55-per-hour job. As reported by the AJC’s Steve Visser, the job “has no written goals or deadlines and has delivered no tangible work product in six months of employment.” Hicks’ time sheet show her working from mid-afternoon or early evening to midnight or later.
Under existing law, in any county with a chief deputy clerk’s position, that person “shall succeed the clerk of the superior court if a vacancy occurs” and serve until Jan. 1 following the next general election. The incumbent, is thus allowed to appoint a successor, an absurd arrangement that opens the door to corrupt agreements.
In counties without that position, the probate judge calls a special election to fill the vacancy.
Since Fulton has the chief deputy clerk position, Hicks gave the job to Cathelene “Tina” Robinson, who in turn brought Hicks back onto the payroll. While the General Assembly is fixing what’s broken, it should too outlaw the practice of expending public money to hire back retired elected officials. To afford Hicks’ hourly charges, Robinson kept two clerk slots vacant. The county signed off on the deal because the superior court clerk is an elected position.
On a larger scale, the state really does need to move out of the defined benefit pension business, which invites the Legislature to create special deals for individuals and interest groups. Give employes retirement money up front, in the form of 401(k)s for example, so there’s no temptation to come back and game the system for unearned and undeserved benefits. Meanwhile, fix the systems Hicks and Robinson reveal to be broken.

Well, me and the missus got fancy last night and decided to go to Locos for supper down in Alpharetta. When we got there and set down at the table we saw a piece of paper that said, bring your church program and get 2 for 1 hot wings at Locos.
What a great idea I thought. The mgr. knows when us rednecks get out of church we are mighty thirsty and hungry. I know I do after listening to the Rev. Postlewaite. He’s big on listing all the sins but not the sinners, the way the Rev. Jim Bob Buice done. The Rev. Jim Bob would come right out and tell us not to vote for libruls and Those People and when to come to the church and march off to the polls. The Rev. Postlewaite just talks about how bad welfare and big guvmint is but he don’t say nothing about the people that’s for it.
I got to thinking while I was eating. I sure want to be in the bleachers when Jesus sentences all the libruls to hell on judgment day. I want to see people like getalife and JK and that Curious Observer guy drug up before him and then hauled off to the flames. They will burn and burn, only they won’t really burn because then hell wouldn’t be eternal so they will just keep getting singed. And I’ll be there watching and clapping.
Anyway, you won’t find good GA conservatives in favor of unChristian things like feeding the hungry for free and giving them shelter and doctoring them when they are sick and such. I know we ain’t stepping into them flames. I’m just thankful we got God on our side.
I can’t wait till the Rev. Jim Bob gets parole and comes back. He never should of been in prison. All he done was take his clothes off so they wouldn’t get dirty when he crawled into them bushes to rescue that nekkid boy. And just then the cops come along and wouldn’t you know it they come to the wrong concluson. We will fire the Rev. Postlewait lickety-split and put the Rev. Jim Bob back in the pulpit.
Wooten is kind of boring today. What does he expect when Those People are allowed to take public office? They just rob us the way the hippy-hop people do tourists downtown. Anyway, its a pretty good racket to be able to step down from your job and appoint the person that’s going to take it and get that person to pay you $55 an hour while you are drawing a couple fat guvmint pensions. I done some ciphering and figured up that this Hicks woman is making more in one day than I do in a week. It ain’t Right. It ain’t Conservative! If we rip the public off we do it all legal-like. Except maybe this Cunningham and Ney and people like that when they get a little too greedy.
Anyway, we need to treat guvmint workers the way we done school teachers back in the good old days. Make them work for almost nothing and give them pitiful pensions when they get old and keep track of what they do in the time they are off and such. When us godly conservatives take over we’ll put a stop to all this stuff.
Anyway, I got to finish my beer run today and get some sleep tonight so I’ll be ready for church Sunday. I want to stay on the Right side with the Lord so I can be in them bleachers when the libruls and commies get their’s.

What’s all the fuss over how much Hicks and her colleagues make anyway? Those numbers are what liberals call “a living wage” in the private sector. That’s a democrat’s wet dream.
Let’s let Hillary bring Mattel back from China in 2010. Then let’s pay each union toy assembler and painter (with environmentally friendly paint of course) $55/hr. Then let’s watch parents pony up $5,000 for a Christmas that used to cost them $500. Oh, and that’s if no strike happened and your precious one had no Christmas presents from Santa because people were b_itching about their free lunches being too spicy.
Let’s then also watch The Hill bring Nike back from China in 2012. Then let’s watch people whine when shoes that used to cost $50 at Kohl’s are priced at $400.

What’s the point of having “environmentally friendly” shuttle tiles anyway? Is that so if the shuttle explodes on blast off the Atlantic dolphins won’t choke on the debris? Regarding Mr. Wooten’s column. One of the ways the public sector was able to hire and keep good qualified candidates (and some not so good or qualified) despite lower salaries was the promise of good benefits, including a pension. If you want to eliminate pensions, better be prepared to pay hire wages. For a contemporary example, look at Tony Snow. He is leaving his post because it does not pay enough.
On that note, you all should get out and enjoy the great weather we are having (even if it is just to do yard work, like me).

I appreciated the fact that you brought up the SCO. I did a lot of reading online after you mentioned it. It doesn’t warrant the attention you’re giving it.
China isn’t on board with Russia. They have too many competing interests which will never allow them to develop a close working relationship.
Putin is all pishy because many of his border states are adopting the western philosophy. He feels defeated and threatened militarily, so what does he do? He puffs himself up like a toady frog in some war games with China.
The funniest part about the SCO meeting was Ahmadenijad. Putin is using him as a threat against the U.S. saying that he (Putin) can keep him (Ahmadenijad) out of the SCO if the U.S. will concede to Russia’s demands.
All of this is being done for the psychological impact, so you need to “pump up” your brain for the battle.
As to your column Jim. There has been abuse by teachers double-dipping because of a loophole in the GPO. Work one day as a janitor within the education system, and you can draw years of social security benefits even though you opted to invest in the TRS and weren’t required to contribute to SS.

Hey, as a teacher, I’d like to have a separate pension based on student-hours taught. Let’s see, 34 years times an average of 30 students an hour times 6 hours a day times 180 days a year equals a whole lotta extra money beyond my “generous” TRS pension. Plus extra for special ed kids and parent meetings after work.
One thing I find hard to understand: I make the max a teacher (without coaching or administrative duties) can make in Georgia, and I have been doing it quite a bit longer than Ms. Hicks, yet my “generous” state pension will amount to less than $50,000 per year. I also have a PhD. (Admittedly I am only paid for 190 days of work per year. However, I also have only 11 days of sick leave, no comp time or paid vacation). I guess Ms. Hicks must’ve worked a WHOLE lot harder than I have!
The legislature has no interest in looking at situations like Ms. Hicks because of their own sweetheart deals they anticipate when they “retire”.

actually, woohooten, I do own a gun (old .22 rifle) but it has not been fired in so long it is probably more useful as a club but have been looking for a decent shotgun (I am also a lousy shot). As for radical islamists like the saudi’s that W the incompetent just sold a bunch of high tech weapons to. I seem to recall that it was mostly saudis who were involved in 9/11 and that the only iraqis were the ones in W and Cheney’s imagination.

Well, I might of knowed Sister Dusty would roll out of bed with her claws out and hissing and making it look like I live in a mansion and drive a Lexus beer truck. She’s always been mean down at the Church of Holiness and I don’t expect anything diffrent when she’s gone from there.
Sounds like everybody is loaded for bear and ready to blast away when the terrists and commies knock at their door. I just hope the guvmint don’t outlaw guns. When they outlaw guns only terrists and commies will have guns.
They made a big mistake when they didn’t hop on my idea of letting everybody carry guns in their truck and use the toll booths on GA 400 as ammo stations. One day we’ll be mighty sorry when the Chinese and Russians come marching up the interstate and we’re out of ammo and all we got is a rusty old 22 to bash them with. We won’t even be able to defend ourselfs against the Iraq people that will follow us home when we leave there and start bothering our women and thumbing their nose at us and picking us off one by one.
I guess the only way we are going to be able to make it is start a war with Iran. We’re kind of winding down in Iraq, so instead of leaving there and let the terrists follow us home we just need to make a right turn right into Iran and sort of head the terrists off. They won’t have too far to travel and neither will we. Me, I’m awful glad we got My President and Mr. Cheney in the White House instead of them Democrat wimps that would start talking to Iran instead of just blasting away. A few A-bombs and them towel-heads will be ready to see things our way.
Well, lunch break is about over. The chicken weenies was mighty tasty. Be sure to go to church tomorrow. We need plenty of prayer and lots of bombs.

President Bush should really think this out. I know we’re talking about Bush. But just for once can we dream? Think Bush, think.
Would invading Iran really be a wise idea? Look what happened in Iraq. Millions of people claimed to support the war, but where are they? They are all staying the hell away from the war.
And the Media. The President has been abandoned by the conservative media. When was the last time anyone read anything by Jim Wooten that encourages young Republicans to enlist? Fight for their country.
Where is the Republican Party? They should be actively encouraging their own to enlist, serve their country. The Georgia Young Republican website says nothing about serving in the military.
If I were Bush I would be totally outraged that so many of his supporters won’t back him up.

Of course I could read DailyKos and Huffington Post where they simplify for the simple mind or, if I wanted to let others do my research AND my thinking. But alas….I am a curious sort. I’m humble enough to realize that there are world leaders who will pursue their strategic interests no matter what I say or think.
On the other hand, I’m smart enough to know that many, many moons ago, this country had the opportunity to wean itself from foreign oil suppliers, but we didn’t.
One reason was the environmentalists stood in our way, and it was “fashionable” for the Democrats to support them. The second reason is because it was easier and more cost effective to turn a blind-eye to the impending results of neglect.
Negotiations in the ME were “fashionable” too, but they sure didn’t come with the rewards we had hoped for.
There are five members in the SCO. Most, if not all are guilty of crimes against their own people. Three of them harbor no animosity towards the U.S., that’s why they see no need to admit new members, Iran in particular.
China? I don’t know, the jury is still out on them, but they do need relationships with the U.S. for now.
Currently China is benefitting from business ties in oil-rich Africa. I say great, that country could sure use some investment.
As countries develop so does their demand for oil. While they’re pursuing that, we’ve implemented programs for alternative fuel sources, but that too will take time.
Putin? Pished. Why?
It’s 26 to 5 he’s already behind in the game. That’s why he has to puff himself up to look bigger and more threatening.
You will want to keep an eye on the elections in Ukraine though. That’s one of the things that got Putin’s panties in a bunch, the Orange Revolution. He accused the U.S. of turning Ukraine around in the last election. Couldn’t possibly have been because Putin is wielding the old hammer, now could it?
The EU needs to step in on that one. I’ll be listening in on the chatter over there.

But that buildup was for the ONE nation, not for another nation on the other side of the globe that we would be fighting as well. The only thing I might disagree with you is the idea that Chinese oil investments in Africa are good.
I have only heard about their interest in the oil prospects in Sudan. Some of the major prospective oil fields lie in Darfur. I have heard that is one reason for the genocide there. If China has made any protests about Darfur I haven’t heard of them.
Last night on Lehrer News Hour, the humanitarian projects done in Djibouti on the horn of Africa were pictured. There’s an important base there and the miitary has spread out into the small desert country and built schools, medical facilites and dug wells in the desert for villagers. After all the good things were mentioned, some liberals came on and said it was WRONG because it confused the picture of the military. The citizens of Djibouti were not confused. They were all for it and Americans.
Africa is so full of potential and terrible situations both. It is truly a maze of mishaps and possibilites.

Have you noticed that the neo-cons don’t use the term “cut-and-run” anymore since it has been reported the Gen. Petraeus has recommended that the troop levels in Iraq be cut. The White House has publicly stated that the White House will write the report about the progress in Iraq and Gen. Petraeus and Ambassador Crocker will attend the Congressional presentation.
I ask the conservatives to give a logical explanation as to what we are doing to fight terrorism in Iraq to “keep them there and not have to fight them here?” Dubya literally said it does not matter what ANYONE else says, he will make the decision as to how this “war” is being fought. When the ground forces of the military are broken - with all the Generals saying we have until spring to get this resolved - what happens when another conflict starts? Who will we send to defeat the “terrorists?” Will we have to start the draft again? The War Czar says it is something that needs immediate consideration. My, my, ny. Details getting in the way of rhetoric.

“Given Beijing’s undisputed leverage with Khartoum, engaging it further may be a promising avenue in the international community’s efforts to bring peace and security to Darfur,” the report concluded.
Can they be trusted? Maybe, maybe not, but they can be watched. A lot of their current investment is entrepeneurial in nature.

They said if we did not stop with the complaints about their currency manipulation, they would cash in their IOU’s (something in the neighborhood of $4 trillion dollars). A few facts about China and it’s business practices are: they have options on most of the world’s timeber; the have the fastest growing Navy in the world and have more diesel powered submarines than any Navy in the world; they have options on most of the world’s oil including Sudan, Venezuela and ostensibly Iraq; they have the world’s fastest growing automobile market; they have one of the world’s largest military; all the money we spend at Wal-Mart goes directly to the Chinese military.

When Saddam Hussein was OUR BOY, there was never a problem with al-Qaeda because he hated them and he did not want competition for his job.
Osama Bin Laden was OUR BOY in Afghanistan and we used any means and methods to arm these folks to get rid of the Russians. A case of man bites dog.
You make this innane statement about my not supporting our troops in Iraq. I support our troops completely, I do not support the policy of Dubya. To further that thought, we are not fighting “terrorists” in Iraq, we are fighting citizens of an invaded country that do not want us there; we have killed more than 700,000 innocents to defeat the “enemy”, an enemy that YOU CAN NOT NAME!
The troop problem did not come from me, it came from those who are in the management of the Pentagon. One way we could alleviate the troop problem in Iraq is declare victory, move our troops to Afghanistan and bring Osama Bin Laden to justice.
I am a big anti-war liberal that can not support what Bush is doing to the troops and the Constitution. With your mantra of being a CONSERVATIVE, you should be jumping up and down that your commander-in-chief has lied, cheated and stolen from you and your family to perpetuate this war.
If we have a draft, it would mean EVERYONE will share in the sacrifice to protect this country. It would mean that instead of employing “lip” service, we would employ “hip” service; get in line and raise your hand to protect and defend the Constitution from all enemies, foreign and domestic. You say you support the troops but not Bush. That is impossible. You can’t support armed forces and not support their commander-in-chief. That is possible in words only, not in reality.
I have heard NO announcement from the Pentagon that we will have a draft. That’s more your scare tactic than their policy.
Our Constitution is quite intact and working. Liberals pointing fingers at it does not change it. More propaganda from liberals.
I know you are a veteran. I also know that my father, husband, and son are veterans. I appreciate the service but it does not change the obligation of any citizen whether they have been in the armed forces or not. The obligation to support our country is the same.

About 50 Gaza terrorists a week are being killed, wounded or captured by these operations. There has also been a reduction in Kassam rockets being fired into Israel, caused by a shortage of fertilizer (used to make propellant and explosives) in Gaza.
Meanwhile, Israel and Fatah continue to cooperate and negotiate. Fatah is cooperating with Israel in identifying and arresting Palestinian terrorists who continue to operate in the West Bank. Israel is willing to negotiate a deal to establish a Palestinian state in the West Bank, and leave Gaza for later. But the Palestinians must be able to control their radicals, or it’s no deal.

Under existing law, in any county with a chief deputy clerk’s position, that person “shall succeed the clerk of the superior court if a vacancy occurs” and serve until Jan. 1 following the next general election. The incumbent, is thus allowed to appoint a successor, an absurd arrangement that opens the door to corrupt agreements.
Perhaps Mr. Wooten, a great reporter, will explain to us mere mortals how a departing clerk is allowed to appoint a successor, given the fact that by statute the chief deputy clerk succeeds the clerk—precisely what happened in this case. Do tell.

My car’s navigation system actually said, “You cant get there from here.” I was trying to drive to Lovejoy from behind the locked fence at the police impound lot.

When I tried to drive to the bridge to nowhere, my car’s navigation system started complaining about congressional earmarks, and vowed to vote for Hillary.
One thing that bothers me about homegrown terror cells here in the USA is that post-911, where was the publicized profiling about what to look for as we all became deputies of liberty (read vigilantes)? Another of those class acts from the Reagan administration is gone, and leaves behind, a legacy of lacking in ethics.
Deaver was celebrated and scorned as an expert at media manipulation for focusing on how the president looked as much as what the president said.
This innocuous little man was the innovator of the then new found Republican success of style over substance?
But not atypically for that political party, he apparently had a little problem with ethics as his conviction on perjury charges relating to investigating his lobbying activities with administration officials attests. (In other words, paying people off with dirty money to get what you want.)
And, rather than taking advantage of an opportunity to raise the ethics bar, and rather than clean up their own house in the ensuing decades, as anyone who cares to look can see, not only was this trait of lying and corruption to become a GOP mainstay for the next 25 years, the party actually lowered the bar with new and repeated scandals, rampant corruption and a host of morality issues.
Family values, whining about moral equivalency and pro-life slogans notwithstanding, many of the “leaders” of this new Republican Party and their enablers, have proven over a very considerable period of time that, in reality, they are anything but.
This (and that little quagmire overseas) cost them the elections last November. Will it cost them this time around too?
There are so many of the faithful sheep out there, and the Democratic Party is also such an abysmal mess, only time will tell.

Well, me and the missus took our church program from this morning down to the Locos in Alpharetta and showed it and got 2 for 1 wings, along with a couple PBRs. The service at the Church of Holiness was real good, it had Ella Mae Loudermilk singing and backed up by her brother Gilbert on the guitar. The Revrend Postlewaite was kind of dry, but most people stayed awake thru it. I didn’t see Sister Dusty there but I guess she had a bad hangover and didn’t feel up to it.
I wish Wooten would kick this Pope guy off of this blog. All he does is throw off on us godly rednecks. Wanting dogs to eat us and such. He’s as bad as this God Hates Trash guy. We need to get rid of all the libruls here. That includes getalife and Curious Observer and JK and Corky and the whole bunch. This is a conservative blog and libruls ain’t welcome here. Let them start their own blog. Nobody wants to hear from them.
I guess jbmlaw and TFTT is still at church. You got to pray alot before you start talking about kicking the lazy and poor and sick people in the rear and making them pay for their own doctoring and such and leave us good Christians alone to make our wallets fatter. God meant us godly conservatives to do good and have plenty of money for lunches and suppers out. But God meant for the bums and Those People and the lazy and sick to have a hard time of it till they go to work for us.
Anyway, I’m sure glad I don’t live in Fulton County and pay the taxes that make all of Those People rich off of feeding at the public trough. Up here in Forsyth County we don’t have many of Those People and we put our money into more roads and such. Maybe more of the good white Christian people will break off of Fulton County the way Sandy Springs and Johns Creek and Milton done. You can only put up with so much. Then Those People will need to find some other way to rip taxpayers off.

Liberals refuse to recognize tax revenues are at an all-time high (it is the tax cuts stupid) and the conservatives refuse to reduce spending and enforce our laws. My reference to Liberals and Conservatives is to those who claim one or the other as their political position.

JD, it appears that you took umbrage to my comments about the sheep in the GOP. As I have no inkling who you are, I don’t get it, but nonetheless, I see it happen here often.
Yet, you agree with me on the crux of my argument, and my oft-made point about a near complete dearth of true conservatives and how that negatively impacts America.
And like me, it is clear that you believe that the two political parties have put themselves first and the nation second. Which is another argument I have made repeatedly.
I don’ think the answers to the many problems in this country can be found any longer in liberalism. At least not as it exists in its extremist form today.
And IMHO only more and bigger problems are being created by the neo-conservatives in the GOP.
To me, there are two possibilities left - a vital conservative movement that eschews most of what Reaganism and the ensuing 25 years have wrought. Or a strong independent party that can function as a mediator between the two extremes and inherently self-serving incompetence of the existing political parties.
