The right one is punished

If I’m the lawyer for the City of Durham, N.C., we pay. We write the checks to three members of the Duke University lacrosse team in sums that are at least sufficient to pay the millions of dollars in legal fees run up by their families. And while a civil suit is unlikely to produce much in financial compensation from the accuser, she, too, should be forced to defend herself publicly.

For rogue prosecutor Mike Nifong, justice came quickly on Saturday, when his license to practice law as yanked. On Friday, he tearfully resigned the District Attorney position he used the three Duke athletes to win. And more punishment may be around the corner. Nifong told the judge overseeing part of the original case that he knew of no information helpful to defense that he hadn’t turned over. At the time, he knew that the stripper’s underwear and body offered up DNA from several men, but none from the defendants. The judge may act on that deceit. And, of course, the lawyers for the three would certainly include Nifong in any civil suits to be filed.

Nifong incited the class and race prejudices of Duke faculty, Durham residents and commentators thorughout the country with comments that included a vow made at a campaign forum that he’d not allow the community to become known for “a bunch of lacrosse players from Duke raping a black girl.” To gain political office, he would have destroyed the lives and careers of three innocents. In the end, only one was destroyed. The right one.

Tony Snow stuck to the White House line on March 15 when describing the U.S. Attorney purge:

[W]hat the President has — the Department of Justice has made recommendations, they’ve been approved. And it’s pretty clear that these things are based on performance and not on sort of attempts to do political retaliation, if you will.

As The Daily Show’s Jon Stewart explained this week, after showing a clip of Snow’s quote, “That was three months ago. Three months later, a dozen subpoenas, six hearings … thousands of released e-mails, it turns out that their performances were actually pretty good. And all signs are now pointing to political motivations. I wonder how the White House is going to reconcile this apparent discrepancy?

Which leads us to Snow’s spin from this week:

Q: Okay, but at the beginning of this story, the President, you, Dan Bartlett, others said on camera that politics was not involved, this was performance-based.

MR. SNOW: That is something — we have never said that.

Snow does realize that people record these press briefings, right? He understands how easy it is to check when he insists “we have never said that,” doesn’t he?

It’s almost as funny as when White House officials tried to convince reporters that the administration has “never” had “a stay-the-course strategy.”

I can almost understand the Bush gang lying; I just wish they were better at it.

Nifong needs to go to jail for a long time too. This case was essentially all about ensuring his reelection to a powerful well paying job. His obscene racial pandering was as sickening as anything ever seen from the black congressional caucus. And the lynch mob mentality of blacks both locally and nationally who went along for the black hate crime ride could not have cared less about the THREE INNOCENT white lads. Indeed the morose barely audible apologies since the case completely unravelled have been in such revealing stark contrast to the gleeful noisy screeches of the lynch mob at the start of all this.

The ONLY folks who still have their dignity intact are the white lads and their families and supporters who sensibly stood with them as the party of hate liberal media perpetrated a modern day lynching based SOLELY on black racist lies and the unhinged leftist mindset that never ever looks beyond the shrill cries of racism from bigoted hateful blacks, despicably egged on by their bigoted white enablers, looking for yet another payday!!

All the millions of sick and twisted white and black racebaiters who racebaited this non-crime owe the Duke players a huge grovelling apology.

tihs is the scary thing about the justice system in this country as it presently exists. in this case, the justice system worked properly. most of the time, however, you get the justice which you can afford to buy.

i should have been more specific. the justice system worked properly in the nifong trial. in the players’ case, the justice system did not work until the state attorney general got involved. if the players’ families did not have the money for good lawyers, who knows how this thing would have gone.

* The God of war* I do feel for those falsely convicted. They should be compensated. However, in the cases you mentioned did the prosecutor have evidence that these individuals were innocent. Did he withhold that evidence. If that can be proven those prosecutors should serve the sentence of those convicted. But we are forgetting the main culprit in this story. She just walked away clean. Where is the justice?

Mike Nifong has finally received the rebuke he justly deserves for his unconscionable abuse of power. There can be no doubt of his motives in using this case to help him in his reelection campaign. I am glad that the North Carolina officials stepped up to properly address this.

This illustrates once again the dangers of an overwrought appeal to emotions being used by a power hungry demagogue. Taking highly emotional issues like class envy and race and playing to the crowd is nothing new. Nifong probably thought he could get away with it and let these players go to jail if it meant he could use it to stay in office. Their lives mattered nothing to him and they were disposable consequences. He didn’t count on it becoming a national story and therefore coming under heavy scrutiny

As I was watching the Disciplinary Committee announce their findings, I could not help but see the similarities in Nifong’s tactics and those of charlatans currently active such as Al Sharpton, John Edwards, Harry Reid and Howard Dean. They have no plans, no solutions, no answers other than to play to the crowd’s emotions in their insatiable thirst for power. Denounce, divide, agitate, these are their tactics and unfortunately they are also the sum of their ideas. Equally sad is that their dim constituency is always unable to recognize the campaign for what it is. They hear the divisive message and rally behind it giving no thought to solutions or the consequences of empowering the hustler seeking power.

The Duke players better thank their lucky stars that they were charged in a state like North Carolina which ultimately showed the decency to do the right thing. Had they attended a school like Columbia in New York where such divide and conquer tactics carry the day I’m afraid they would be in jail today. Tawana Brawley made Al Sharpton a hero in the Democratic Party. Nifong might be presidential material if he were a local prosecutor from New York

Oh,poor innocent lads get into trouble when hired stripper falsely accuses them of rape. Now taxpayers in NC will pay for their pain and suffering. Perhaps the Duke guys could write and sell an instruction manual for “Building Team Esprit On Saturday Nights!”

First, make sure all your underage teammates keep their fake ID’s so you can continue to go to the strip clubs. It’s so hard to find good help nowadays on your own.

Second, make sure that the strippers who show up are white, since that’s what you requested and the crowd doesn’t want to see a couple of ethnic types. Send them back, you’re the customer, and the customer is always right. Honkeys only, no exceptions.

Third, make sure the strippers who show up aren’t falling down drunk and drugged. Just drunk, like you are.

Fourth, if a contract dispute arises with the aforementioned strippers, don’t ask them if they brought sex toys, then offer them a broom handle for a good substitute.

Fifth, don’t shout racebaiting slurs when the not-white-enough strippers retreat; it sets you up for racebaiting unethical prosecutors.

This case is such a terrible tragedy. The lives of the three boys ruined by the harshest of allegations and the actions of an overzealous prosecutor costing him his livelihood.

I think we all have so much to learn from this case. First, people (whether white, black, brown, yellow or red) really ARE innocent until proven guilty. Second, the system works, but sometimes it works against defendants.

For those that think that Pressler got a raw deal (including ESPN), I would respectfully disagree. As a former college athlete (non-scholarship football, which, admittedly is different than scholarship DI football, basketball, and lacrosse), I can tell you that this coach had completely lost control of his team. There is no way a coach of a major program should allow this type of behavior in-season while in pursuit of a national championship.

What most people forget is that the players weren’t exactly choir boys. Once this initial accusation came out, others came forward with stories of harrassment, hazing, out-of-control drinking, racial epithets, etc. The coach was clearly not doing something right as these are not the qualities of a Duke student-athlete.

Similarly, I hope and pray that we won’t all look at this accuser and allow it to somehow diminish the credibility of future rape victims. I cannot imagine the courage it takes for a victim to point out her attacker and re-live the most brutal moments of her life. We must find a way to ensure that victims come forward and feel protected while ensuring the rights of the accused… clearly, there was not the right balance in this case.

I’d guess that anyone that DA has convicted will be petitioning for the verdict to be set aside, as his willful breaking of the law has shown he was willing to do.

As a woman, I am furious at the young woman who made the charges, as patently false accusations like these make it harder for real victims of rape or sexual abuse to be treated seriously.

BTW, everyone “panders”. It just bothers you if they pander for a cause in which you disagree.

Mike Nifong used this case as his stepping stone to political power precisely because he knew that accusations against privileged white male athletes by an underprivileged black sex industry worker would bring the media in droves. Where are the lessons learned by those who rushed to sensationalism and judgement in their own self-interest?

The media and the educational establishment leaped upon this story without investigation or reflection precisely because it fed thier own preconceptions, providing an outlet to vent their collective spleen. As a Duke alum, I am disgusted by the initial actions many of its students, faculty and administrators, all of whom have thus far failed to admit their own improper behavior.

The press is supposed to inform the populace, not pander to race baiting. A university is supposed to encourage open minds and unbiased exploration of fact. Duke, in particular, has had an enviable reputation for insisting on academic achievement and appropriate behavior from all of its students, athletes or not, which only fed the gusto of the press in exposing the “depravity” of the lacrosse players as well as the overreaction of the administration.

The lesson here is not just Nifong’s, who has been justly served. What has the AJC learned about knee-jerk racial sensationalism, the self-interest of the accusers and the cost to the innocent? Nifong sees where he “stepped over the line” - who among the media covering the story has said the same? And what is the university’s accountability?

I am overjoyed that North Carolina’s attorney general declared three former Duke University lacrosse players accused of sexually assaulting a stripper innocent of all charges, ending a prosecution that provoked bitter debate over race, class and the tactics of the Durham County district attorney. Rouge prosecutor Mike Nifong should face the full weight of the law.

African Americans can’t secure the rights guaranteed by the Constitution of the United States because too many don’t understand the relationship between acquiring institutional power and the blessings of liberty. It wasn’t good lawyers per se that freed Duke University’s Reade Seligmann, 20, of Essex Fells, NJ, and Collin Finnerty, 19, of Garden City, NY and David Evans, a 23-year-old senior from Bethesda MD from the clutches of Mike Nifong and the criminal justice system; it was a benefit of his group having institutional power.

African Americans will continue to experience untold suffering piecemeal through our own neglect until we come to understand the relationship between institutional power and freedom, justice; the blessings of liberty. Our only hope for justice any place on earth is to build black institutions. To conjure up undeniable legal and social arguments over rights denied without institutional power is the height of stupidity.

White Americans would be wise to watch the film produced by Aaron Russo, freedom to fascism. It’s available on the internet free of charge. He shows how tyrants in the United States are well on their way to render white children helpless and without power in the very land which their fathers conquered; White Americans adults should act now while you still have time.

RCH, thanks. I appreciate your words of reassurance. My concern is more the women (or men) who might fail to report assault because of this case. Not saying it is right to be afraid to report, just that it is a possibility, especially when you are talking about something so personal as sexual violation.

I am having a hard time believing some of the comments here. Bottom line is that except for their families’ ability to raise about $3 million, these three men would be in jail. Follow the logic, people. How many in NC, black or white, are in jail because they did not have that kind of support? What Nifong did in the wake of the accuser’s false story should make all of us worried. Who would have been next? What if your father or brother or son (or for that matter, mother, sister, or daughter) was the next person implicated without evidence in a case that was politically beneficial to the DA? Did they find your mother in a car that matched the description of one that hit a kid from the poor part of town? Who cares if there was no evidence or worse exculpatory evidence including a video of her car at Walgreen’s when the hit and run took place. She “fits” the “profile” and besides - only rich, white women drive Volvos; she can afford the cost of a trial.

It isn’t about the lax three - it is about you and I and everyone that could become the next 10-point swing in an election year.

And to the person talking about firing the coach - Spring Break is Spring Break. The kids are out of school; he could have given restrictions but the chance of listening is about the same as any other late teen/early twenty year old (male or female). Hiring a stripper is pretty tame - what did you do on break in Cancun or Florida?

Your outrage reflects poorly on your judgement and self-interest. Think and be angry about the injustice that could have happened to them and work to fix it. You could be next. Let me say that again. YOU COULD BE NEXT!

Charles, I blacks in this country have adequate means to obtain justice but, like other impoverished groups, they oftentimes don’t have the resources to access it. Your lobbying for special “institutional power” has something of an ominous and un-democratic ring to it.

I think people don’t want to see African Americans with real power. There isn’t anything threatening about African Americans having institutions capable of meeting our basic needs.

I think all people would benefit from it. Real integration could be achieved. The crime rate reduced. The prison industrial complex would be a thing of the past. A people of substance could be born. That’s good for Democracy, Republic.

Those who profit from our present inept condition would be the big losers. So, it’s not going to be easy. They are going protect their money to the death.

We’ve known for a while that the president has a habit of issuing signing statements, through which President Bush tells Congress which parts of certain laws he’s wishes to ignore. Well, the General Accountability Office, Congress’ investigative arm, looked into how these signing statements affect administration policy.

The GAO issued its report today. It says, that the Bush Administration failed to execute the law as instructed in over 30 percent of the cases.

Isn’t there something in the Constitution about to the effect that the President “shall take Care that the Laws be faithfully executed”? A minor technicality to him — I’m sure.

As a former teacher I just do not want to miss this “teaching moment.”

YES it is wonderful, fabulous, just, etc. that the three Duke lacrosse players were exonerated after being wrongfully accused.

NO it is not acceptable for a student-athlete to be at a party with underage drinking, hire a stripper, refer to her as a n&%$er, and have e-mail fantasies about racial violence.

We should all tell our kids two things here:

1.) As SGT Dave says, “you could be next.” Keep your nose clean and avoid being guilty by association.

2.) You represent God, your family, your school, and your community in everything you do. Any mistake you make brings shame to all of the above.

Thanks for posting an intelligent and cogent thought that was not based in politics or self-absorbed opinion. You nailed it, most of the people here are missing a very important point. Everyone of us could fall prey to circumstance and the aspirations of an uncaring system. Most people fail to realize that in the course of their every day activities (specifically driving as in the example you brought up) they are one bad decision away from losing their freedom or getting in a world of legal hurt. These kids were very lucky that the outrageous behavior of this DA was brought to light by their capable legal defense team. How many people are in jail because they could not afford such astute lawyers? How many of us would be in jail if faced with the same set of circumstances?

The Lacrosse kids really found out who their friends were in life…

Nifong got promoted to his level of incompetence and lost everything.

And when you order Irma LaDouce, and the doorbell rings and you get Anna Lucasta on crack, slam the door in her face.

As far as the voters who elected Nifong based on a man-bites-dog story, they got what they deserved also.

We still remember Tawanna Brawley, Al Sharpton and all the rest.

And this is news?? It’s history repeating.

I’m surprised that people do not understand the power and craft of New York legal-PR operatives. A classic case: attack the victim, disgrace the prosecuter, make sure the boys don’t have to testify under oath talk, bury the facts (DNA of Duke lacrosse players was connected to the woman, though not proven to be that of the the accused.)meddle in the politics of the NC legal system. It worked perfectly. They got to the media; they got to the NC bar association; they got to the NC AG. The justice system was obliterated. No one took the stand; no was proven innocent or guilty. Some day the truth will come out.
