Alpharetta contractors’ conviction overturned

The federal appeals court in Atlanta has vacated the tax conspiracy convictions against a father and son who operate a commercial drywall contracting business in Alpharetta.

Gerard Marchelletta Jr. and Gerard Marchelletta Sr., of the Circle Group, were convicted in October 2007 and sentenced to prison. They were granted bond pending appeal.

In a recent ruling, the 11th U.S. Circuit Court of Appeals said the Marchellettas deserve a new trial because the judge did not give a jury instruction that was requested by the defendants’ attorneys. Bill Rankin
