Gwinnett ex-officer indicted for Taser prank

A former Gwinnett County police officer was indicted Wednesday for allegedly stunning a Waffle House employee with a Taser as a prank.
A grand jury indicted Cpl. Gary Miles on charges of aggravated assault and violation of oath of office. He resigned from the department last June. Miles is out of jail awaiting trial on $8,100 bond.
The waiter, Daniel Wilson, 23, told investigators that Miles was a frequent patron of the restaurant at 2725 Grayson Highway in Loganville. Wilson said he was chatting with two other Gwinnett County officers on Feb. 16, 2009, when Miles came up from behind and zapped him with the Taser. He said Miles and the other officers laughed as his knees buckled and he fell to the ground.
Miles told investigators that he only "spark tested" the Taser near the employee's back "just to scare him a little bit, " according to an internal investigation file. A lawsuit that Wilson filed against Gwinnett County and the three officers is still pending in State Court.
