Duluth eviction leads to SWAT standoff

An eviction order Wednesday morning led to a four-hour SWAT standoff between Gwinnett deputies and the residents of a Duluth home, Channel 2 Action News reported.

Gwinnett deputies asked occupants Howard and Novalee Graber to exit their home in the 3200 block of Davenport Park Lane, but they refused to budge.

During the standoff, some nearby homes were evacuated.

Neighbors told WSB-TV that Howard Graber is disabled, and that is why he did not come to the door.

They also said the couple had filed paperwork requesting a trial, which should've stopped the eviction, but police said they did not receive any court orders.

“It's a violation of her civil and constitutional rights, blatantly,” Martin Benjamin, a neighbor, told WSB.

The Grabers were booked on one count each of misdemeanor obstruction. They remained jailed Wednesday night.
