Deputy's alleged shooter released from hospital to jail

A DeKalb County sheriff's deputy shot while serving a warrant was in stable condition Monday afternoon following surgery at Grady Memorial Hospital, officials said.

Meanwhile, his alleged shooter was discharged from Grady and transported to DeKalb County Jail, a sheriff's spokeswoman said.

Joshua Matthew Waller now faces two counts of aggravated assault, in addition to the simple battery misdemeanor charge from the original warrant Cpl. Gary Freeman served him Sunday night at the Keys Crossing Condominiums.

Waller opened the front door of his condo holding a gun and shot the 13-year law enforcement veteran in the forearm, DeKalb Sheriff Thomas Brown said. Another deputy returned fire, striking Waller in the upper torso.

Waller then barricaded himself inside the condo for several hours, Brown said. The 36-year-old surrendered to police shortly after 11 p.m., emerging from the residence to request a cigarette. He was transported to Grady for treatment late Sunday.

Waller has previously been arrested three times in DeKalb on drunk driving charges, the sheriff's office said.
