Evans had been scheduled to appear in Atlanta Municipal Court Wednesday in the drunken driving case that led to his resignation.

Evans was arrested late on the night of June 30, just five minutes before a new contract paying him over half a million dollars annually was to take effect.

A state trooper pulled over his 2009 BMW for making an erratic turn on Roswell Road in Buckhead, according to the police report. Evans was charged with DUI, illegal lane change and failure to submit to an alcohol test -- all misdemeanors.

The trooper found Evans, a married father of two, in the car with a 28-year-old woman whose red panties were in his lap, the report stated. Evans' companion, Courtney Fuhrmann, was charged with disorderly conduct for allegedly refusing to obey a trooper's request to stay in the car. She is scheduled to be arraigned Jan. 13 on her misdmeanor charge.

Evans resigned five days after the incident and is currently working in Boston. UGA chose Greg McGarity as his replacement.
