Two months after giving away $1 million, state school superintendent files for bankruptcy
The Atlanta Journal-Constitution
State School Superintendent Kathy Cox, who in September gave away the $1 million she won in a game show, has filed for bankruptcy.
Her husband is a builder hit hard by the economic collapse.
This is in today’s Athens Banner-Herald::
“On November 17, after consultation with numerous attorneys, my husband and I made the difficult decision to file for bankruptcy due to losses incurred by his home building business,” State Schools Superintendent Kathy Cox said in a statement issued Friday by her office.
“The collapse of the home building market has been well documented and small builders, like my husband, have been hit especially hard. This was a gut-wrenching decision, but in the end, we felt that we had no choice.”
Cox issued the statement, and a similar e-mail to school superintendents, following a story that appeared in the online version of The Newnan Times-Herald. According to the article, Cox and her husband, John, filed Monday for Chapter 7 bankruptcy, with $3.5 million in liabilities and just shy of $650,000 in assets.
Only last September, in a giddy peformance, Cox became the first $1 million winner on the FOX TV series “Are You Smarter Than A 5th-Grader?” by answering correctly the question: Who was the longest reigning British monarch?
She gave the money to Macon’s Georgia Academy for the Blind, Clarkston’s Atlanta Area School for the Deaf and Cave Spring’s Georgia School for the Deaf.
My AJC colleague Rhonda Cook talked to Cox spokesman Dana Tofig today. He said that Cox created a “gift foundation” with her winnings that will protect it from family creditors. Tofig also said that none of the $1 million would be used to administer the foundation — i.e., no individuals will profit by it. The cash still goes to the three schools.

She actually set up a nonprofit organization in her and her husband’s name. She was required to contribute the money to an organization. She originally said she was giving funds to the state schools, but then set up the private corporation where she could control the money.

Isn’t there a bankruptcy rule concerning disposal of assets within 12 months of filing so as to protect creditors — especially secured creditors? If so, does will her donations have to be returned?

imho, she was and is unqualified for the job she has, winning election only because her last name was Cox and voters confused her with the Secretary of State who has the same last name and a similar first name. Kick her out of office, bankruptcy should disqualify her from holding elected office.

Time are really hard for everyone. That goes to show that no one is exempt from the economic disaster that we are facing. Credit card companies are calling and stressing people out. I pray for everyone who is going through this rough time.
I have read stories where people are killing themselves because creditors are calling and they have no money to pay. Let’s keep everyone in our prayers.

My heart goes out to them on some level, I guess but I really have to ask the question: She can lead all of the schools in the State, but can’t even manager her own finances? Pretty sad. Maybe now financial literacy will be required in schools!

I will not laugh or make fun of anyone facing what they are facing. It could be any of us next. If you feel that she shouldn’t have been elected to the position she holds vote her out come next election. Be fair, and wish her the best at this time. As far as her winning the million on the television show, she gave the money to wonderful groups & I belive she will be blessed for having done this. DHD you are right. We should not pass judgement on anyone. Because as you can see you can have a job today and everything can be lost tomorrow and we can end up in the unemployment line. I don’t always agree with Cox, but to call her unqualified is ridiculous. She’s a former teacher and state legislator. People tend to get qualifications and political philosophy mixed up at times.
I know folks say she was elected because of SOS Cox, which is still irrelevant to her qualifications, but I don’t think she won because of SOS Cox. The state had already voted for a GOP Superintendent and GA was trending Republican.

Bubba, you raised a very good point. In sum:
“Gifts or transfers of property by you to others during the twelve months or in some cases five years prior to your bankruptcy are subject to review by the Trustee and may be reassessed by the Court. If a creditor or a person related to you received special treatment (such as being paid while others were not) the Trustee may demand repayment from them. The Trustee must be advised of any such payments or transfers made during the twelve months prior to bankruptcy.”
Of course, it may be that Cox was playing on behalf of a named charity and the payout was paid directly to the schools and did not pass through the Cox’s personal finances.

Ms. Cox’s predecessor, Linda Schrenko, used the office of state education superintendent to enrich herself and is now a resident of one of Georgia’s prisons (unless she’s out - it’s hard to keep all of Georgia’s incarcerated public servants straight. Bill Campbell .. Robin Williams .. Charles Walker .. etc.)
Ms. Cox clearly could have used a little “loan” from the state of Georgia. But instead of using her office to pay her personal bills, she opted for the difficult, embarrassing route of declaring banktruptcy. I’m guessing the filing is a public document, so her financial dealings will be up for public review.
In another ironic twist, I think Schrenko swiped some money meant for a school for deaf kids to bankroll her face lift. The same group of kids would later benefit from Cox’s donation.
What a humbling experience this must be - yet what strength of character this shows. How many public officials anywhere, especially facing dire financial difficulty, would resist the temptation to cook the books a little? (See former Alaska Sen. Ted Stevens for example)
Hats off you to Madame Superintendent. Thank you for your humility and honesty, and for putting students and taxpayers first. Best of luck in squaring your family’s situation away. No matter what, you’ve set an inspiring example of someone willing to tackle matters head-on rather than take a less than honorable way out.

sorry this happened to her, but this problem has been aided and abetted by the republican administration. oh yes sub primes were at fault and dems wanted everyone in homes, but the repubs were at the wheel (prez and congress) for 6 years and did nothing to curb the tide which many of them say they saw coming. they and the majority repub crooks on wall street all need to be punished by running from office or put in jail.

If any builder belives that that should be on any ones sorry list I have some news for each of them as they reap their just deserve. Now its your turn to suffer.
You used every way in the book to get prime dollar for the sticks you glued together. You took advantage of illegal immigrants, low interest rates, encouraged sub prime loans so you could walk away from a hous closing with exhoribant profits, sometimes as much as 100%. For get it builders you will find no sympathy from us the screwed over home buyers.

Dear Brad, et al: Just being a teacher does not qualify one to manage a billion dollar branch of government….the school system in Ga is pretty worthless, ranking 49th out of 50 most years. Money from the more affluent Metro Atlanta counties is diverted via the state’s ill named qbe program to support rural Ga schools. Meanwhile, thoses of us in Metro Atlanta who believe in high standards in education are paying 19 and 20 plus mils on our property taxes to support the schools, while the deadbeats in Rural Georgia are paying the minimum 6%. And still they fail, yet Cox and her ilk spin the numbers to claim the rural schools are getting better. They are not, they just now have our money with which to over pay their teachers who are mostly just baby sitters. Cathy Cox is the problem…or is it Kathy Cox…Soon I will not have to pay the school tax, as when I reach 62 Cobb county exempts me from the tax on my primary home. Fire Fat Girl Cox NOW…

I have worn the shoes that Kathy is now wearing not because of hard economic times but because of stupidity. I know the embarrassment she and her family must now be experiencing and my heart goes out to them. What I don’t understand is some people’s need to criticize the situation especially in these extremely difficult financial times. More so, those of who take up space here to point fingers and critique her job qualifications, should sit down and take a good look in the mirror. One day you may yourself be on the other side of that mirror.
Whether she is or is not qualified for her job has nothing to do with the point at hand nor does whether she was or was not required to give away the money she won or how she set it up to give it away. She gave it to those schools who needed the help and she will be blessed for it. Somehow she and her family will come through this. When God closes one door he always opens another and in Kathy’s case, maybe three.

A) She was a school superintendent, and
B) The questions were easier than usual.
The show wanted to make a splash. If this is true, then this is extremely poor journalism by the writer of this article.

To the jerk who implied Sec. Cox could not handle her own finances, let’s hope you never have something happen to you as catastrophic as the economic downturn has been to builders. There is a big difference between making bad choices/financial mismanagement and circumstances beyond your control. Anyone who isn’t clouded in judgement by political dogma, anyone who can actually think and care, knows that this was beyond the Coxes control and feels nothing but empathy for what must be a very difficult circumstance for the family. Anyone who says otherwise is really letting the rest of the world know he or she is incapable of thinking and feeling.
There, but for a car accident, medical condition, or economic downturn in our own industries goes any one of us. Whether you agree or disagree with her politically, the bankruptcy says nothing about her, her character, or her abilities.

There is no regulation that would require the money to be given away. What we have is an act of generosity tht benefited 3 state schools, followed by an unforseen downturn in the economy. She got bitten like thousands of other Americans. Bury the political vitrol for once and see humanity.

Feel bad for her, but at the same time, think that she is now out of her element. She needs to get a job in the public sector where she can earn $$$ for her family. Can see how it would be very difficult to attempt to solve the major problems this state has with public education with the finances of her own family being held over her head. At a time when the state is loosing high paying jobs, a focus needs to be on turning out skilled students. Just heard this week that we have another school system in north Georgia that is going to be placed on SAC accreditation probation. Someone needs to take charge of public education in the state.

I don’t feel sorry for her or her family. I’m sure Mr and Mrs Cox are intelligent enough people to have created some kind of “front” where they/she has control of the funds. This financial hardship did not just appear, I’m sure they knew their financial situation and took that into account when she “gave” the money away. I’m not sure, but I would almost bet that as superintendent of schools, Cox was required to give the money away to a charitable organization. She’ll be ok, let’s worry about the average Joe and Jill…

Mr. and Mrs. Cox had to file bankruptcy because of problems with his company. The economy caused the problem - NOT anything Mrs. Cox did or didn’t do as Secretary of State. She seems to be doing a pretty good job herself and, if not, the people will show their displeasure when election time comes again. Instead of driving another stake in the Cox family’s collective hearts, why not show some humanity to a family that’s already hurting. HOWEVER, if you cant manage your financial situation then you can not hold public office in my opinion. if you are walking out on your responsibilitys to people and companies you owe money to then you SHOULD NOT be in public office. “Smart” does not mean able to do rote memorization, which is all Ms. Cox did on that show and all public schools teach. Smart is being able to think things through and make good decisions. IQ tests measure reasoning abilities, NOT rote memorization.
If schools taught children how to think, as opposed to what to think, kids would be able to make wise decisions as adults, such as knowing how to ride the inevitable economic waves we encounter as adults.
The economy isn’t great right now, but look around you. Do you know even one single person who doesn’t live in a much larger house than they grew up in? Everyone has so many electronics and clothes they can’t use them all, and every family has a car for every adult, etc. etc. etc.
I fired the school system and have homeschooled for ten years. To do so, I gave up my business and an income of 75,000 a year. We have lived on my dh’s income alone for a decade. He works in a far more fragile industry ( museums) than Ms Cox or her husband, and I’m certain his income is lower than hers. We’ve weathered 9/11 and Katrina, which both devastated the museum industry, and reduced his income by about half. Our debt? Zero. Why? We own a house we can afford, shop second hand, and most importantly, we never shop on credit. We own the same electronics and other toys as everyone else, but we only buy them when we have money on hand.
Kathy Cox is filing for bankruptcy because she is spoiled and stupid, just like the dolts her schools are churning out. Her family could live on her income alone. They have simply chosen not to.

I have worn the shoes that Kathy is now wearing not because of hard economic times but because of stupidity. I know the embarrassment she and her family must now be experiencing and my heart goes out to them. What I don’t understand is some people’s need to criticize the situation especially in these extremely difficult financial times. More so, those of who take up space here to point fingers and critique her job qualifications, should sit down and take a good look in the mirror. One day you may yourself be on the other side of that mirror.
Whether she is or is not qualified for her job has nothing to do with the point at hand nor does whether she was or was not required to give away the money she won or how she set it up to give it away. She gave it to those schools who needed the help and she will be blessed for it. Somehow she and her family will come through this. When God closes one door he always opens another and in Kathy’s case, maybe three.

I must admit that I do indeed feel sympathy towards Mrs. Cox and her family, however, I am displeased with her service and her staff. I am a teacher that has had a case to be investigated for bogus accusations/allegations! She personally knows the Superintendent in the old school system where the accusations against me occurred! I have been up for a hearing due to allegations that have no merit simpy because students said I did things because I would not give them grades they didn’t deserve! This has been on-going for the past two and a half years!
I do not gloat or boast when others are down; however, I do feel that you cannot commit wrongdoing and expect to prosper! I keep getting the run around and I am sick and tired of it! I have since pursued another career but am currently unemployed! One thing I must say is that God certainly takes care of His own and that revenge is His!
I do hate the fact that Mrs. Cox and her family are going through at this time! We all are going through but I feel that God is changing and correcting things! We must first be changed on the inside and then He shows it outwardly! When we learn and endure throughout our experiences, He gets the Glory because it is God that brought us through!
I pray that not only Mrs. Cox and her family recover but all of us as a whole! Our educational system needs to be revamped! Money is wasted on new programs that come out every year! STOP REINVENTING the WHEEL!!! Use what we have that we know works and expound on that! But this is not the time to emphasize our educational needs!
I must say that I believe that she will not get my vote the next time around! It is time to put the good old boy system to rest and to work for fairness and justice!
This does go to show that no one is exempt from problems. As long as we live, we will have problems! It is up to us to either deal with them and survive or succumb due to them!
With God as the head, whom many in the nation have tried to remove from schools and now the pledge, we can heal and conquer this economic situation, but we must first unite! Divided, as we tend to be in today’s world, we will fall!
We must respect our President-elect! How can we expect for him to run the office effectively if he is worried for his life every ten minutes? God is tired of our mess, and until we try to correct things and get it right, He will continue to pour out his wrath upon the US!
In closing, I would like to say that I pray that we as a people pull together! Pray for Mrs. Cox and her family alongside the entire world and first and foremost recognize who Christ is, go to Him in prayer seeking His face, then He will heal our land! But, we must be His humbled people called by His name! Believe that it is already done and we shall have those things that we believe! When two or three are gathered in His name, He will be in the midst of us!

She did an admirable job on 5th Grader. She is also a better superintendent than that last one who embezzled the Title 1 money for a trip to Hawaii and a facelift. Then she whined about having osteoporosis so she could not function in prison. WELL IF SHE HAD QUIT TRYING TO BE A SIZE 2 SHE WOULD NOT HAVE HAD IT!!!! She should not be disqualified for filing bankruptcy. It has happened to a lot of people thanks to W and his cronies sending our money to Iraq to line the pockets of his boys.
Now as for electing Republicans, if the people of Georgia were not so stuck on stupid to keep electing Republicans, we would not have Republicans in office. It was a fluke that Sonny got in the first time. Roy Barnes had to go because he was abusing and disrespecting the teachers and it could not be allowed to continue destroying the education system that Zell Miller had worked so hard to improve. Then the flaggers voted with the teachers and put Sonny over the top. We did not really want him in office, just wanted to humiliate Roy and get him under control. He did not do well in school at South Cobb High so he hated teachers. I heard that from someone who went there with him. But there was no excuse for a second term for Sonny! Yall are not ALL Catholics and Southern Baptists.
Now Sonny is almost finished. The federal government has taken a positive turn with a Democratic President and a Democratic Congress. It is time for Georgia to go back to doing right and go back to freedom, respect for others, and good common sense. North Carolina went for Obama. She did an admirable job on 5th Grader. She is also a better superintendent than that last one who embezzled the Title 1 money for a trip to Hawaii and a facelift. Then she whined about having osteoporosis so she could not function in prison. WELL IF SHE HAD QUIT TRYING TO BE A SIZE 2 SHE WOULD NOT HAVE HAD IT!!!! She should not be disqualified for filing bankruptcy. It has happened to a lot of people thanks to W and his cronies sending our money to Iraq to line the pockets of his boys.
Now as for electing Republicans, if the people of Georgia were not so stuck on stupid to keep electing Republicans, we would not have Republicans in office. It was a fluke that Sonny got in the first time. Roy Barnes had to go because he was abusing and disrespecting the teachers and it could not be allowed to continue destroying the education system that Zell Miller had worked so hard to improve. Then the flaggers voted with the teachers and put Sonny over the top. We did not really want him in office, just wanted to humiliate Roy and get him under control. He did not do well in school at South Cobb High so he hated teachers. I heard that from someone who went there with him. But there was no excuse for a second term for Sonny! Yall are not ALL Catholics and Southern Baptists.
Now Sonny is almost finished. The federal government has taken a positive turn with a Democratic President and a Democratic Congress. It is time for Georgia to go back to doing right and go back to freedom, respect for others, and good common sense. North Carolina went for Obama. Ga. Const. 1983, Art. 2, § 2, Para. 3. Persons not eligible to hold office:
No person who is not a registered voter; who has been convicted of a felony involving moral turpitude, unless that person’s civil rights have been restored and at least ten years have elapsed from the date of the completion of the sentence without a subsequent conviction of another felony involving moral turpitude; who is a defaulter for any federal, state, county, municipal, or school system taxes required of such officeholder or candidate if such person has been finally adjudicated by a court of competent jurisdiction to owe those taxes, but such ineligibility may be removed at any time by full payment thereof, or by making payments to the tax authority pursuant to a payment plan, or under such other conditions as the General Assembly may provide by general law; or who is the holder of public funds illegally shall be eligible to hold any office or appointment of honor or trust in this state. Additional conditions of eligibility to hold office for persons elected on a write-in vote and for persons holding offices or appointments of honor or trust other than elected offices created by this Constitution may be provided by law.

To Nekisha Flemister: I too was fired for trumped up charges. In my case it was a racist principal in Atlanta Public Schools who told me, “You don’t care about the children. You all (white people) never care.” and “YOu all just have to be at the front”. Even sent me over to Big Bird (long timers in APS know who that is) and spread the word I had been suspended. Big Bird could not find where I had done anything either. (The principal grew up in Perry Homes. I think she resented white people for her growing up poor.)
She had been prompted to attack me, by another teacher who was so incompetent that she could barely read, but who could not be gotten rid of because of her family connections to upper administration. She thought that I had reported her for child abuse several years before. (Nope! But I knew who did and encouraged him because she could not touch him. She had whacked a favorite student of his for laughing when she did something stupid. He was an adorable visually impaired child who used a wheelchair, a crack baby with a great personality.)
The racist principal could never get me for anything but insubordination but she could not ever say what I did that was insubordinate—-other than teaching while white, of course, and she would not admit to that. The racist teacher I had worked with for 4 years during which time she had threatened to “kick my fat white a—-“, had told everyone not to vote for me for Teacher of the Year because they did not want a white person to represent their school (probably stuffed the ballot box to make sure), made a show of not eating behind me at the buffets because “White people are nasty”, wrote her name all over her new trash can “because white people steal”, and told the principal she could not be be treacherous “because only white people are treacherous.”.
You must have been working for a suburban system. I knew Cobb County would cause problems, but they had a job in my area. A student with a history of behavior problems in another system, including stabbing a paraprofessional with a pencil for calling her retarded and intentionally running over another one with her electric wheelchair, decided she was going to get rid of me because I would not let her talk about sex and drugs in a class where there was an innocent 14 year old. (She was 17.) Her mama worked for a large law firm. Assistant principal thought the allegations must be true because the girl was physically disabled.
Another teacher got let go because she gave a student a 0 on his homework because he did not turn it in.
This is the problem with the schools. Teachers are considered disposable unless they are well connected—-a Delta, Q-dog, or AKA, preferably from an AU center school if they work in Atlanta. White people are hired with two strikes against them.
In other systems, especially wealthy suburban ones, it is a matter of who you know or are related to. Parents rule because the scariest two words ever spoken are MEDIA and LAWSUIT. In those systems the parents have the time and money to do a lawsuit, to come up to the school and complain and to try to make the school the way they want it, where their little darlings are catered to. Sometimes the parents are right, however and need to use those words, especially when the teacher is a bully or incompetent.
In a rural system there were two teachers in one position. I had over 20 years and a Masters. I taught a student to read who was considered severely retarded but was really Tramatic Brain Injured. The other teacher had one year and a Bachelor’s degree. She was very jealous because I was so much better than she was. She was little and skinny and whenever she went to talk to the principal she wore her miniskirt. He was prone to hiring teachers who would get stopped coming out of the cafeteria because other teachers thought they were students. Monica had no clue about how to teach the students, but she was shacking with the father of the Superintendent’s grandchildren and their birth mother was unstable. So guess who was kept at the end of the year!!!
It is not just in Georgia, however, that this happens. Teacher disrespect is the result of conservatives in government where. if you don’t fit exactly into their round hole, you don’t fit at all. This is caused both by conservatives in high places (Appealing to the state superintendent does not work) and the availability of cheap, inexperienced, one degree and alternate certified teachers.
The schools are bad because you get what you pay for. I was and am an exceptionally good teacher in my field. I have been known to do things no other teacher was able to do. But I was the wrong color and a square peg. I saw the first alternate certified come in when I was in Cobb. To say they were bad was raising them a level. Not only did they have no skills but they were arrogant and thought they were better than real teachers. This is what Teach For America teaches their not-teachers. They tell them that teaching is not a career (This comes from the Superintendent of Washington DC schools who was a TFA and is bribing teachers to give up their job security.) but a step into better things. They only commit for 2 years which is not long enough to become a good teacher. It takes 3-5.
But nobody could ever say I was not a good teacher. God would have struck them with lightning for lying. Strange how being good is never good enough. YOu have to “fit”. The administration does not care about the kids or the teachers. They care about keeping their jobs and those almighty test scores. The children are suffering.
Barack is going to make changes in No Child Left Behind. Hopefully he will get rid of it altogether so that the schools can go back to teaching. Then we can begin to get some square pegs back into the schools because we are the ones who care. WE are the real teachers, the ones who know that education is not something we do, it is something we are. I have always said I would take the bullet for my children if a terrorist or drug dealer came through. There is no question about that. One witness at my hearing who had been brought in by the prosecution ro impugn me, when asked if I cared about the children said, “If anything, she cares too much”. That is how it is. When you are with the children they should be the most important thing in the world to you. They are a second family, only to your birth kids. If you feel that way, you will do everything you can for them. You will go the second mile. They will learn. They will love you even if they don’t like you. Good, dedicated teachers make for quality schols. That is what we need to get back to.

According to the head of the Georgia Bankers Association, speaking in Marietta last week, the problems the Cox family are having has nothing to do with an economic crisis, the “Welfare for Bankers” bill is really an investment. The voodoo house of cards is falling. Too bad so many good people are being caught up in the political posturing, underlying noble ideals, voters thought they were supporting. Follow the money. And we need to vote for Chambliss to keep the farce going. Stupid!

I feel bad for the Cox family but after reviewing the facts of the bankruptcy filing,the bottom line is they spend more than they make, and are way overextended in credit. I could live on a salary of $125K per year.

My heart goes out to the Cox family. Bankruptcy is NEVER an easy choice to make. Pondering the decision takes time and searching for ANY alternative way to survive. I think Kathy Cox and husband need our prayers and support during this traumatic time in their lives.

It is always good to know that we all must suffer the same perils as the next person. Economic times have put a strain on everyone. I don’t feel for the Coxes because they have lived the lavish lifestyle and the path they chose was their own. On the other hand we of the middle class know that it is just another political ploy. These are the people who govern our society. My thought for today is what the heck you made your bed now lie in it. You will regain what you have lost throught eh bankruptcy just as D. Trump did. There is an agenda in all of this. To all the people out there watch this couple and watch them grow financially due to their current Bail Out…

They should ask the government for a bailout. if bankruptcy is good enough for the Cox family it is good enough for the auto industry. At least our tax dollars will not go to this family, enough during these hard times. I don’t know how many cars they have but maybe they can sell one or two.

I don’t know Cathy Cox, but I do know that she gave away one million dollars to help children. To me, that is remarkable and unselfish to say the least. I am very saddened at all the hurtful, rude remarks that some are making about her. I wonder, would those of you who are so critical, give away a million dollars? Giving away a million dollars is not something people do every day. Who is Cathy Cox? She is someone trying to help our children on many levels. She is someone who put her personal money where her mouth is….It is so sad to think people are actually happy when something terrible happens to another human being. And this is the week of Thanksgiving!

KATHY COX is a Republican filing for bankruptcy, in charge of Georgia’s abysmal schools, from which barely 6 in 10 children actually graduate, and who’s test scores are near the botton of the nation’s. Kathy Cox should be compelled under pain of perjury to answer one question: Why did tubby and her high-roller hubby purchase TWO vehicles when they already knew they were in a tight, financially speaking? Surely, with her salary, she fails the means test of eligibility for Chapter 7. If she had a scintilla of integrity, she would submit her resignation immediately and cease stealing from the taxpayers of Georgia.
