Barr and Boortz on illegal immigration, and what to do with those already here

Former Georgia congressman Bob Barr, now exploring a Libertarian bid for president, had an interesting exchange with Neal Boortz on WSB (750AM) this morning.

Apparently, among some conservatives, there’s been some dispute over where Libertarians stand on the issue of illegal immigration.

“The Libertarian Party has not exactly been strong on the issue of controlling the Mexican invasion into this country,” Boortz began.

“Actually, they have been,” Barr replied.

The two gentlemen moved to the matter of what to do with the paperless people who are already here.

Said Barr:

“You set a mechanism internally to determine who is here. And if you catch folks that are here unlawfully, and do not submit themselves to a background check that those coming into this country are going to be required to do, then you send them back to their country.”

Said Boortz:

“It sounds to me that you’re saying, if you find an illegal immigrant in this country, and they’re willing to submit to a background check, that that could open the door to them staying here.”

Said Barr:

“I think as a practical matter, that makes a lot of sense. I’m not sure how you would go about rounding up millions of people and trying to deport them. The key here is security….”

First of all, it is clearly racist to even mention borders or permission to enter the U.S. - protected borders is something only other nations can get away with.

But…the problem took 20 years at least to develop, no one should expect the illegal immigration mess to be straighened out over night.

I still have some hope for border security, punishment of employers, and removal of those found breaking the law, as they surface. If we decide to “legalize” some of the folks who are already here, it should be on a very selective basis, with lots of penalties paid. (For example, parents who have not been supportive of their children’s education would NOT be candidates for legalization. Folks who have been arrested are NOT candidates for legalization.)

I also think we should not make children born of a mother here illegally an automatic citizen.

Lest you think I hate Latino folk, I do not. I have taught hundreds (literally) and most of them are terrific—good parents, hardworking etc. They could be candidates for legalization if they can jump the other hoops.

I just don’t think we can reward behavior we want extinguished, and expect it to work.

It is very simple, take away the reason they are here. Stop employment at the employers doorstep. When illegal immigrants are stopped arest them. If no work and they know they will be deported and lose what they have, they will gather up their things and leave. It’s called enforcement. By the time the next president is here and starts to do something, there will be 30 million. That is we must fight harder and press the politicians. When they start to worried about losing their jobs they will come around.

Mexico was paid for the land. It was a legal purchase. We did not take it!! If you would like to discuss the Mexican-American War, fine. But brush up on your facts. The area of Texas and disputed lands just west and north of that area, was decided by force, but the rest was purchased. If you don’t like the force part, then take it up with the Texans… I dare you. But CA most of the southwest was purchased. Those are the facts.

I am an immigrant in this country. I came here legally. Letting people come here illegally and letting them stay will mean the abolishment of the rule of law in America. Every one of the 12 to 20 million should be encouraged to head back home to re-unite with their families in Mexico or wherever else. Mexico does not put up with illegals, why should America? Amnesty to illegal is a slap in my face as someone who respected America’s rule of law.

Odd how no one is addressing the key point - punish the AMERICANS breaking the law. Ignorant people are quick to scream “law breakers” to the ones crossing the border but no one wishes to punish those ‘patriotic flag-waving’ types who are repeatedly breaking the law by employing these people. It seems no one realizes this is a supply and demand issue. Kill the demand for low wage labor by throwing out HEAVY fines and revocation of licenses to the AMERICANS breaking the law and cheating the rest of us out of tax money. If it becomes so risky and costly to hire illegals, the demand will drop off. No demand means the illegals go look elsewhere. Simply put, this is a proper solution to getting rid of those currently here. God forbid we EVER think of punishing our fellow Americans who are breaking the law.

Gary, besides your obsession with “man love”, you missed the point. For those crying about punish the law breakers, they failed to address the fact that Americans are breaking the law just the same. But nothing is said about punishing them. If it is a law and order issue, you must punish all law breakers. These people cannot argue this is a ‘law and order’ issue unless everyone breaking the law is punished.

1) We purchased our territory from Mexico, but what option do you have when your country is under occupation? It is like pointing a gun at the head of someone to sign a document. There was no question the Mexican acquisition was imperialist.

2)There is NO Roman Catholic conspiracy, alright? You are an idiot if you believe that…sheesh. Think logic. Logical explanations for every situation you put forward are available. Conspiracies are rare; happenstance convergence of interests is common, and often occurs in unforeseen ways.

3) I think everyone would agree that the first priority would be to close the border, then locate all illegal immigrants already in the country and force background checks. The question afterwards is do you deport them all or not? I for one do not think amnesty would be that big of a deal IF the border were closed down and all immigration regulated properly thereafter. You can’t just deport them all. I would suggest first creating policies to citizenship in exchange for service in the military right after closing the border. They would be illegals in the US on the fast track to citizenship and helping to allow the US to fights its wars(no matter how immoral they are, we shouldn’t suffer a troop deficit). But this can be sorted when illegal immigration is ended.

It sounds nice, BUT: How do you “run a background check on more than 20 million people when their home countries are so corrupt/ How do you run a background check using the US crime records when the illegal sall have six aliases they have used when run through our jails?

No, the answer is slowly making them go home on their own, like they are from Ga, Az, Ok, and here in Colorado. All of these states have proven that enforceing the law deters illegal immigration…by punishing the employers and the illegals….it is called ATTRITION THROUGH ENFORCEMENT. GOOGLE IT!

We need to stop acting like this is unstopable…it isn’t. We need to act like Mexico does ENFORCE THE LAW!

Cezar Chavez, worked to deport illegal aliens. He encouraged Latino/Americans and legal aliens to report the criminals. He even started Minute Man style patrols of the border to stop the illegal aliens from getting in.

These criminals depress wages, cause taxes to go up, and hurt the lowest income Americans the most. President Eisenhower cracked down on the criminals and millions of them who didn’t get caught self-deported. It would work again.

THE INHERENT AUTHORITY OF LOCAL AND STATE ENTITIES TO ENFORCE IMMIGRATION LAW

The authority of local and state law enforcement to enforce immigration law is an inherent power of local and state jurisdictions. Former Attorney General John Ashcroft “announced the unequivocal conclusion of the Department of Justice Office of Legal Council (OLC): arresting aliens who have violated either criminal provisions of the Immigration and Nationality Act (INA) or civil provisions of the INA that render an alien deportable ‘is within the inherent authority of the states.’” As sovereign entities possessing “all residual powers not abridged or superseded by the U.S. Constitution,” the states possess what are known as “police powers,” which are “‘an exercise of the sovereign right of the government to protect the lives, health, morals, comfort, and general welfare of the people…’ Manigault v. Springs, 199 U.S. 473, 480 (1905).” State power to enforce federal law derives from the status of the states as sovereign entities. One sovereign can assist another sovereign in the enforcement of its laws. The only restraints on these powers would come from specific prohibition in the U.S. Constitution, or preemption by Act of Congress. Neither apply in enforcement of immigration law.

Abundant case law confirms this inherent state authority to enforce immigration law. The U.S. Supreme Court, as recently as March 22, 2005, unanimously ruled that police did not violate a woman’s constitutional rights by inquiring about her immigration status while searching her residence. The Supreme Court made clear in its ruling that police officers do not need reasonable suspicion to ask a suspect for his or her immigration status. This is an important development in the law. Previously, the circuit courts had assumed that reasonable suspicion was necessary to inquire about immigration status. The Supreme Court in this case, Muehler v. Mena, equated inquiry about immigration status with inquiry about name and date and place of birth. In Mena, a search warrant authorized a search of the premises where Iris Mena resided for deadly weapons and evidence of gang membership. Mena, asleep in her bed when law enforcement arrived, was handcuffed and asked her immigration status. The Tenth Circuit Court of Appeals in United States v. Vasquez-Alvarez, 176 F. 3d 1294, 1295 (1999) recognized the “preexisting general authority of state or local police officers to investigate and make arrests for violations of federal law, including immigration laws.” (The quote is from the opinion itself.) In that case, a police officer of Edmond, Oklahoma, arrested the defendant “based solely on the fact that Vasquez was an illegal alien.” In Vasquez-Alvarez, an INS agent requested an Edmond, Oklahoma, police officer to investigate a situation involving a suspected drug transaction. The suspect admitted to the police officer that he was an illegal alien, and the arrest was made solely on that basis. Other recent cases upholding the arrest authority of state and local police in immigration law violations include United States v. Favela-Favela (Tenth Circuit), Lynch v Cannatella (Fifth Circuit), and United States v. Rodriguez-Arreola (Eighth Circuit.) In the Favela case, a local police officer noted a passenger not wearing a seat belt. After stopping the van, he noticed twenty people inside. The driver admitted that his passengers were illegal. The driver and passengers were taken into custody. Upon being summoned, INS agents took charge. Eighteen of the twenty passengers were deported, and the driver was convicted of transporting illegal aliens. In Lynch, Jamaican stowaways on a Mississippi River barge were detained for several days by the Port of New Orleans Harbor Police. This detention was upheld by the Fifth Circuit. In Rodriguez-Arreola, a South Dakota state trooper asked the immigration status of the occupants of a car stopped for speeding. The passenger admitted he was illegal. The officer placed the illegal alien in custody to await INS processing. Initially, the trooper and INS considered the detention part of an administrative procedure. The Eighth Circuit upheld the legality of the arrest, implicitly recognizing the authority of state law enforcement to make an administrative (or civil) immigration arrest. Kris W. Kobach, formerly with the Office of Legal Counsel of the Justice Department under Attorney General Ashcroft, and now professor of law at the University of Missouri-Kansas City School of Law, cites five examples of congressional action manifesting an intention not to preempt inherent state and local arrest authority. These actions are in essence invitations by Congress to local and state law enforcement to help enforce the nation’s immigration laws. The five are: 1) Section 287(g) of the INA (8 V.S.C. 1357(g), providing for written agreements with state and local law enforcement agencies to provide training and assistance in immigration law enforcement; providing, however, that a written agreement is not necessary for local and state authorities to enforce immigration law; 2) Congressional authorization for reimbursements to states for the detention of illegal aliens (8 V.S.C. Section 1103(a)(9), and for their arrest, transportation, and detention (8 D.S.C. Section 1103(c); 3) the Law Enforcement Support Center (LESC), serving as the principal point of contact for local and state law enforcement with INS/ICE; 4) Formerly designated “Quick Response Teams” to further facilitate INS/ICE response to immigration arrests made by state and local police; and 5) Express congressional barring of “federal, state, and local entities from preventing their officials from exchanging information with federal immigration authorities regarding the immigration status or citizenship of any individual.” (8 D.S.C. Section 1373 and 8 US.C. Section 1644). All of the congressional actions enumerated above are post 1990. It should be borne in mind that all state and local action to help enforce immigration law is entirely voluntary. In fact, rather than impose costly burdens on state and local entities, “it has been the regular practice of the federal government to reimburse such agencies for any detention costs incurred.” At least 47 criminal offenses are found in federal immigration law. Misdemeanors include entry without inspection (crossing the border illegally or without authorization), failure to comply with the registration requirements, and making knowing false statements on a registration application. Illegal reentry is a serious felony. Illegal reentry applies to aliens who have been denied admission, deported, or departed under a voluntary departure order. Most smuggling activities are felonies. Document fraud (such as forging, counterfeiting, or altering documents) and benefit application fraud (false or fraudulent claims or representations to obtain an otherwise valid document) are also felonies. Overstaying a visa is only a civil, deportable offense. Civil offenses are not insignificant, however. All four of the 9/11 hijackers who were stopped by local police prior to that fateful day were in violation of civil provisions of the INA (Immigration and Nationality Act) only. Actually, considerable overlap exists between civil and criminal provisions of immigration law, and it would be very difficult in practice to require a police officer to distinguish between them in making arrests. No such knowledge is required, for local and state officers have ability to arrest for both civil and criminal violations of immigration law.

Yeah, well… it is mean to enforce immigration law, and it may be bad for the environment. If you build walls or fences some rabbits other “animals” may be blocked from hopping across the border. So there. Plus, more poor people= more democrat voters.

Anyone notice how the new rich homes going up look like fortresses and military compounds? Revolution is coming, maybe even civil war. They obviously are planning for it. The root cause? The best of both worlds, racism and classism.

As globalization mixes our cultures, our fears are simply too much and we clash, first over religion globally, and here at home over race and class.

I always suspected that the turn of the century would bring chaos, and of course the gloom and doom of the internet dates on New Years Day, 2000, were the ironic and moronic fruition of my suspicions.

No, when people have nothing to lose and see the injustice of institutional conspiracies to disable the american dream, then chaos ensues.

Bush made laws to disable our constitution under the guise of fighting one or two terrorists. We are already sitting ducks for any new fascist regime that manages to convince us he’s the one we’d like to have a beer with.

My inner-patriot called. He wants his country back.
