Do you favor an immigration ordinance for Gwinnett’s landlords?

People feel passionately about illegal immigration in Gwinnett, judging by comments posted on this blog.

Many of you blame a lot of our county’s problems on it.

For instance, when I asked “Who is committing the crimes in Gwinnett?”

Someone who used the initials “SBW” wrote: “I have daily e-mails sent to me about all arrests in my county via “scangwinnett” (an online police scanning site). 99% of them are Hispanic and many times 100% of them are Hispanic. That’s not being racial…that’s a FACT.”

When I asked “What code violators would you report?”

Someone who used the name “Meg” wrote: “It seems laws only apply to average American citizens and not to immigrants or the slave traders who hire them.”

When I said “Gwinnett’s growing population needs traffic relief,” I got this response from “EX Gwinnettian:”

“The illegal population had brought a big influx of traffic to Gwinnett. If they would do something about the clunkers without tags, etc. there might be less traffic. The illegals have also brought an extra “rush hour” traffic….around 8 pm after the construction jobs close.”

It sounds like you’re fed up and want something done about it.

Cherokee County recently passed an ordinance that would require landlords to gather and keep information on renters. When asked by the county, they would have to turn the information over for verification of legal status with federal databases, according to AJC reports.

Landlords who rent to illegal immigrants would risk have business licenses suspended. (Cherokee County commissioners also made English the official language of the county.)

But lawsuits filed against the ordinance have so far kept the county from enforcing it because of the threat of high legal bills.

I bet counties around the state, including Gwinnett, are watching closely to see how this story will play out. If this ordinance survives, there is little doubt that other counties will enact their own versions.

Gwinnett cannot control or enforce who crosses our borders, but if the common theme is “We want them out,” perhaps the county should look for way to make it more difficult for illegal immigrants to live and work in Gwinnett.

But before you decide if Gwinnett should have a similar ordinance, I would ask you to consider two things:

Such an ordinance would mean that people would give up rights as private property owners.

And it would mean further governmental intervention in your lives, which, judging from your comments to this blog, is something you are vehemently against.

I’m sure I know the answer already, but would you support a similar measure here in Gwinnett County?

The county does not enforce the codes it has against tenements, I can not imagine any more effort would go into enforcing this idea.

Yes, I would like to see this happen in Gwinnett County. But, I have a question. How could this be enforced with Mexican homeowners that rent out rooms to illegals in their homes. It’s so out of hand. Also, has anyone noticed how many mexicans are riding bikes.

I do a favor the enforcement of an ordinance against landlords renting to illegal aliens in Gwinnett County, in Georgia and in this entire Country. A federal law is on the books already against profiting from illegal immigration and local law enforcement can enforce federal laws. Just enforce the law!

It seems perhaps we should not worry quite so much about those who rent to illegals (even though I believe landlords should be held accountable) as we should those who enable illegals to purchase houses and vehicles using a stolen S.S. number or Tax I.D. number. Remember not too long ago when it was announced the State was cracking down on illegals? Remember the stories about how those who used a stolen S.S. number were rushing to their lending institutions to change the S.S. number for a Tax I.D. number? Wouldn’t you think the lending institutions would question this??? No…The lending institutions don’t care, not one bit or they would insist on ensuring their clients were legal. They just don’t care. True immigrents I have no problem with, but those who are here illegally, those who knowingly (and you cannot convince me they don’t know) purchase stolen I.D.s (and laugh in our face because we are so stupid) and the banks who can’t get their hands on these peoples’ money fast enough should be dealt with. Otherwise why not just dump all the laws, and live in anarchy. I’d be curious as to know whether Americans could do the same in Mexico. I already know the answer to that one, do you? Also, all of you citizens who were born and raised in the Country. .you who have held down steady jobs, paid your taxes, your insurance premiums. How easy is it for you to get a mortgage without having to cough up reams of past financial history. Apparently just we citizens have to comply. Again, legal immigrents are quite welcome…I don’t hate illegals, I do try to understand…but don’t come here, take full advantage of our system and then laugh at us when you finally figure out that you have all the rights and the stupid American citizen is just that…

I support Cherokee County new ordinance and wish Gwinnett County would get on the band wagon. The truth is, they are illegal immigrants. I have nothing again immigrants, just those that broke the law to get here.

After having watched yet another truckload of illegals move into the basement of the house across the street at 11:30 at night about a week ago, how do you think my neighbors and I feel about this question? We are sick of it and that is why there will probably be at least 4 houses for sale this year on my street. All of us have lived in our neighborhood for over 15 years and all of us are getting the heck out of Gwinnett. And guess what, we are all not white people - we are German, Mexican, Italian, Welsh, Venezuelan and born in the USA citizens and those of use who weren’t born here, have all come into the U.S. legally. Goodbye Gwinnett County.

Yes landlords should be accountable for renting to illegal aliens. This is the first line of defense against the hord of illegals living in the county already. Of course they commit crimes. The first crime was settling here illegally. It all goes downhill from there.

It’s a bit ironic that the legal citizens (be they born and raised here or come here legally) are the ones who are uprooting their lives. Isn’t this a bit backwards?

LJ - the illegals might be winning but we can’t afford to lose any more equity in our house and neither can any of our neighbors because the neighborhood is going downhill. It no longer matters how nicely we keep our homes. If you have a rooming house for illegals and their work trucks sitting in the middle of the street you live on, how much money do you think you are going to be able to sell your houses for?

I applaud Cherokee County for taking the intiative on what our Viagra-less Federal Gov’t can’t seem to.

My family immigrated here legally over 50 years ago from Latin America. They respect the laws, rules and customs of this nation, and we EXPECT no, make that DEMAND that everyone else do the same no matter their country of origin. Propery owners who rent to illegal aliens are part of the problem, it’s illegal to hire, harbor, aid, assist, abet illegal aliens. So what if unscrupulous landlords can’t profit from illegal immigration anymore? Let honest, business people get a fair shake. I have to get appropriate tags, drivers license, maintain insurance, why do illegal aliens feel they dont’ have to abide by our laws? Enough is enough. I’m all in favor of ordinances like these.. its time that elected officials take their oath of office seriously and place the safety, health and welfare of the law-abiding citizens and legal residents above those of illegal aliens, their professional advocates, and the profiteers of illegal immigration! It’s not racist, it’s the law.

It should not be landlords’ job to enforce laws of the country. The USA stations troops in half the countries in the world, but does not defend its own borders. It is wrong for the government to force individual business people (landlords and company owners) to spend their money to enforce laws the government itself is unwilling to enforce.

i live in cherokee county. i think its about time that someone took a stand againest the influx of illegals. it doesnt matter what country they are from. i also am tired of punch one for english and two for spanish. if you come to this country learn our language.

i for one would love to see this law enforced and use my tax dollars to enforce it.

when you drive through cherokee county where they can walk to services like shopping they cut through peoples yards and they have no respect for other peoples lives and belongings.

when they developed one part of the county and got rid of the trailor park they moved on to another part of the county. there was gang fights and crime ridden in the area. i for one feel much safer just driving through the area. the gangs are gone and you dont see any more graffiti written on the buildings.. take away their place to live where they can walk to services and shopping and you loose the crime.

my question is why hasnt something been done on the state level. we re-elected a governor that did nothing to keep this from happening and gave empty promises. why didnt he do something during his first term. this is not just a problem on county level its a problem all over the state. did you know that georgia has more illegal mexicans that the state of arizona. the reason is because the state has done nothing and will not do anything until we get elected officals to pass and enforce laws. its not just up to the countys but its up to the state and the country to do something.

Bob, I must respectfully disagree with you. Landlords are in business to make money and therefore (to me) they should be held to a certain standard just as their fellow businessmen are in any other field. It’s a copout to say “it’s not their job” to enforce the laws of the country. It’s no different than a quick stop owner’s responsibility (job) to enforce the underage drinking laws when they choose to sell beer. It’s the restaurant owner’s job to adhere to the rules, regulations and laws for handling food, etc. Unfortunately, as stated by Paulie, apparently there is a state law in place with effectively prohibits such an ordinance.

Legalatina, THANK YOU for your comments! I cannot imagine how those who have worked hard to come over here and live legally feel about this mess. Personally I think it is a slap in the face of each and every person who chose to come legally, pay the price, spend the years and followed the laws just so they could become a full citizen…according to our own laws. WELCOME!

State Laws do not trump Federal Laws. Unless changes have been made to the Federal Law then what is moot is enforcement of the law.

My opinion, enforce the laws already in place rather than wasting our time adding additional laws. The point is moot. Adding laws doesn’t do a darn thing, enforce the ones we have.

Ordinances do NO good. What we, as landlords need to do (as I’ve been saying since the hooplah) is go ahead and rent to them, then turn their butts into INS/ICE. And if they do nothing, keep bugging the heck out them.

Also, when you get the e-mails stating the arrests, you can use the names and go to the Gwinnett Detention Center and look them up. A LOT of them are being held in the jail for INS/ICE. THAT is how I know which ones are legal and which ones are INVADERS.

Gwinnett Commissioners want growth, they want their property values to climb, they want urban sprawl. GWINNETT RESIDENTS don’t want this.

They are in for quite a shock in 10 years when the residents that PAY TAXES and speak English will have all left for safer pastures.

I too am fed up with the illegal folks who live in Gwinnett, especially next door to me who are renting. These folks started off fine; Mexican Man, American Lady, mixed baby. Neither of these adults have driver’s license but were able to buy at car at the Ford dealership at the Gwinnett Place Mall just prior to Thanksgiving. After the man was arrested the week after Thanksgiving for being illegal, his home has become his extended family’s home.(he remains in jail) There are no less than 8 cars there at night.(double parking on a single wide driveway) Two of which have tires that must be aired up each morning before departing. Two cars have no tags and are just parked there. There is furniture propped up on the side yard fence which I see every time I go out the door. There are uninstalled windows propped up on the house left over from the owner who never improved the home as intended, so he just left all the huge, lovely windows to rot. Cars drive up with blairing radios and the drivers leave them blairing while they go inside, sometimes for a good while. Some folks clean out their car while waiting in the driveway, throwing the trash right out the window onto the driveway. It blows into my yard soon after being disposed of. Their dog barks constantly when I am in my yard gardening. And I do mean constantly! Ahhhhh, life in Lilburn.

Sam, It’s not just hispanics that are responsible for graffiti—it’s whites, blacks, asians as well as hispanics. It’s the mentality not one ethnic group that’s to blame. Thugs come in all colors. I think it’s okay to dislike these little thugs but to say you’re a racist continues the problems people have with different races. Grow up, act maturely and if you have to say hateful things at least do it intelligently.

regardless of what is supposed to be required in order to rent to tenants, you are (unfortunately) always going to have landlords who rent AND hire illegals. i work in an industry where i have to work with alot of persons of questionable status. to get through the paperwork at I.N.S. you need to either sleep with someone or camp out in front of the office EARLY to be seen the same day. and processing any request for background check through I.N.S. takes (usually) a minimum of 6 weeks. although i believe there should be accountability, i don’t see the process as something reasonable just to rent a place to a tenant. lenders, landlords, agents (real estate) all deal with these issues on a daily basis. to require landlords to go through some rigorous check of potential tenants is just going to push those same tenants to sidestep the system by having an outsider sign on the dotted line and name the residents as non-responsble adults residing on premises. there is always a way around the system as we have witnessed in other areas. i, personally, am sick of those who skirt the system by working “under the table” while i have to work doubly as hard just to make ends meet. in my industry which is real esate and lending i know that every day we have clients that buy/sell homes, businesses, commercial properties, etc. that do not have “proof of residency”. as long as there is no governmental agency involved in financing any portion of the purchase then ANY person with or without the appropriate paperwork can buy anything. there will have to be substantial govenment legislation before there is no way around the system’s policies. AND there are far too many that have a voice in Washington…

While I think that EVERY county in Georgia should have local ordinances against renting to illegal aliens, a better solution would be to dry up the jobs that bring them here in the first place.

Employers who use illegal labor are nothing more than modern-day slave drivers who profit immensely from their criminal acts. Every penny the employer saves is ultimately paid by us, the legal citizens.

I sympathize with those who are coming here to “make a better life”, but the truth is there are BILLIONS of human beings around the globe that want the same thing.

How many is TOO MANY???

I am a landlord. I have rented to many Mexicans in the past, but the March earlier this year changed all that. I will no longer rent to illegals and I don’t need a law to tell me that I shouldn’t. I do not feel it is my job to enforce immigration laws, but I am an American and I am for America. If landlords and employers would just take this chore upon themselves, we wouldn’t need to be policed.

Citizens have no control over what happens in Gwinnett, so do it really beg to ask us? If you wanna have any say in Gwinnett, you have to pay up to get an opportunity to be heard.

B is ludicrous. ‘Law abiding, tax paying citizens live here’, should be painted on the water tower. Or, ‘Useless commissioners for sale, Best Offer’.

Read the Arrest records every day from your zip code like I do, the majority of last names arrested EVERY day end in ‘O’, ‘Z’, and ‘A’.

Folks need to look in the Dictionary as to what the U.S. LEGALLY defines ‘Racist’ and compare it to what you PERSONALLY define it as before slinging insults and soap boxes.

First of all, Hispanic is NOT a race, so it’s NOT racism. Secondly, as I said in my original post, facts are not racism. It’s a FACT that too many immigrants (I’ll hold back on the the tag “illegal” so you won’t get up in arms) are DUI, with no license, no insurance and fake tags. My ex was hit by one, who totalled his car, and the guy ran and was never caught, so he is available to do it again. My own neighbor was hit by one, who ran after he totalled his car. Thankfully, THIS one was caught, and is being held for INS. But for every one caught, there are hundreds more that are just waiting their turn. Do you want to be next to be hit by one? Do you want your children endangered by the alien rapists, murderers, drug dealers, etc.? We have enough domestic ones.

I used to frequent my local QT. No more. I can’t even get through the front door without wading through a sea of day laborers waiting for work. This is ALL hours of the day and night. They stand under the “No Loitering” (English AND Spanish) signs, and flaunt it. QT has done nothing about it, so they lost a long time customer who spent A LOT of money in their stores.

How about just enforcing the existing laws. If there are no illegals residents then there will be no need to report renting homes to them. Have the police do more traffic checks to check for valid drivers license. This idea as postulated by Cherokee county is merely to address the symptom of the problem rather than the true cause. As my wife once said to me, would you rather clean up spider webs or kill the spider that make the webs, (before PETA reacts), this is an analogy to treat the root cause and the symptons will go away. The question to ask is: How can we know a legal resident from an illegal one. Is it the use of id’s? If it is; address that issue and enforce compliancy. The burden of proof must be on the person to demonstrate they are legal or illegal. So let us stop pandering to feel good and feeble minded solutions to a growing problem and use our minds to effectively assess and remediate the problem.

Secure the borders, fine employers, jail employers after the third offense. fine landlords, and deport the illegal invaders. Unfortunatly all these ideas will never be done. Why - because our govenment is bought off by the chamber of commerce. They no longer uphold the constitution - which they are elected and sworn to do. We are being invaded by the uneducated third world and our goverment does nothing! 75% of legal americans are fed up with it. Vote out all incumbents (Democrat or Republicans) over and over until we get a goverment that does what it is supposed to do, honor the constitution and serve the people (the legal ones).

Myra - call the county zoning enforcement 678-518-6050. Take digital pictures send them email. Don’t give up stay on them. I had the same problem, thats what I did. If it happens again I will do the same. They are not allowed more than 6 cars in the driveway. Eight person maximum to a single family dwelling. It is against the law to park on the grass. Make them back in and out when they have to go somewhere. Take pictures.

The chances are if you don’t have a valid driver’s license or state-issued ID card you are not legally in the country.

If you can’t speak English it’s odds-on that you are illegal. (Legal immigrants are required to have a working knowledge of the English language)

If you think the age of consent is 12 (as it is in Mexico) you’re probably an illegal.

If you carry a Matricula Consular card you’re probably illegal.

If you and 40 of your best friends hang out at Home Depot waiting for day work you’re probably illegal.

If you’re upset because American citizens are finally fighting back you’re probably illegal. (Or a socialist Democrat)
