Mother to testify against man in child molestation

A Clayton County mom pleaded guilty to child cruelty and will testify against the man police said molested and abused her 8-month-old daughter so badly the child is paralyzed, prosecutors said.

Fabiola Delgado Mata, 20, was sentenced this week as a first offender to five years’ probation, said Deputy Chief Assistant District Attorney John Turner. Under the terms of her sentence, Mata will testify against Eligio Chia-Duron, 40, he said.

Turner said the plea means Mata admitted to neglecting to properly supervise her baby, which lead to the alleged molestation.

Chia-Duron is charged with aggravated battery and aggravated child molestation in the incident that was reported Christmas Day. He is not the child’s father, police said.

Chia-Duron tried to have his case dismissed by claiming police violated the Vienna Convention of 1963 by not advising him when he was arrested that he had the right to call the Mexican consulate in Atlanta. Both he and Mata are in the this country illegally, Turner said.

Superior Court Judge Matthew O. Simmons denied the motion.

Turner said Chia-Duron is expected to go to trial July 16.
