No rights for foreclosed tenants

Talk about a Catch-22.

You’re a renter. You’ve paid your monthly rent religiously, on time. But the landlord or property owner has fallen behind on the payments. The property has been foreclosed on, and you the renter, won’t know a thing about it till the eviction notice arrives. Then you only have a matter of days to get gone.

Under Georgia law, tenants are not informed that a property is in foreclosure until after the process is over, according to a recent article by Andria Simmons, a Gwinnett-based reporter for The Atlanta-Journal Constitution.

A state legislator plans to propose 2008 legislation to address the issue, which is more common in the current economic straits.

What, in your opinion, should be the nuts and bolts of such legislation?

That’s easy, Mr. Badie: require a landlord credit check along with the tenant credit check before any lease is signed.

Then, pass a bill to provide temporary housing funding for anyone thus dispossessed. It cant be THAT many people.

But as to the fix itself, well, there can be nothing for tenants. A foreclosed property is property of the highest bidder.

Why cant you so easily fix this? The assembly will come face to face with the very idea of property ownership itself and confront the impossible obstacles in the way of any change there.

Easy solution, inform tenants the same time the property owners are informed that foreclosure proceeding have started.

Absolutely. There’s a reason why they have eviction law procedures in place. These laws should be extended to the renters of foreclosed properties as well. This should be a no brainer, but you just never can tell.

How can you just throw people (renters)out on the streets like yesterday’s trash because the owners haven’t paid their mortgages and/or taxes? It’s only fair and just that they be given ample time to find suitable and adequate living arrangements.

Notify the tenants immediately. A little empathy mixed with a common sense and decency will go a long way with this one.

A Recession is defined as two consecutive quarters of negative GDP growth that is it. No other definitions apply.

No matter what the leather daddy stock broker whispered in your ear last weekend at the Heretic, those are the facts.

It seems like you have no “rights” as a decent, pay-on-time renter anyway!

It would be nice for it to be mandatory to notify tenants of possible foreclosure/ property sales.

But it seems like being a (honest, reliable) tenant means being screwed irregardless.

Typical rental management attitude: 1. You can pay us rent on time, but if you lose your job and might not be able to pay, we’ll keep insisting there’s “no way out” of your lease even though plenty of renters available to take your place.

If we change management or lose the property, too bad!

  • We can put you through hell to get service or get your deposit back, and not tell you all the “catches”, but you can’t do anything. We hold all the cards.
  • I feel for the honest renters, but I think a lot of landlords are douchebags.

    Anybody read Furman Bisher’s latest? He’s talking about brave’s pitching during the football season. Is there anything more superficially mundane and munch-time mealy-mouthed than a football-season-timed baseball report like this one? So what?     With state Sen. Fort (D) making the proposal I’m sure there will be more NUTS than blots in this potential legislation. All that is necessary would be a requirement to notify tenants that a foreclosure has been initiated on the property.

    Look for Sen. Fort (D) to create things like: A renter’s displacement fund to assist tenants in relocating and to recuperate all due renter deposits. Performance bonds required for all landlords to be able to rent property, so as to assure monies will be set aside in the displacement fund and a six month grace period to find new housing before any tenant can be evicted. Now that’s a plan Ole Vince could live with.

    Ole King Roy is busy at the moment suing the county so he can’t pursue these landlords. Seems the county wants to put the small local sanitation companies out into the streets. Stay tuned it is going to get interesting in the case of King Roy v. Queen Wiggins and Jester Bannister – the Jester is now on a taxpayer funded retreat up in them thar hills.

    What can you say, we tried to serve the Jester an eviction notice but a miscarriage of justice occurred !

    MHS: You give Bannister too much credit when you call him a jester. The jester knew that it was his job to act as an idiot to entertain the crowd. I don’t think Bannister is acting and I don’t even think he fathoms how poor a job he is doing.

    Who knows how things would be going had Bannister got thrown out but it is hard to imagine things being any worse.

    The renters should get a 60 day warning to vacate. The banks will just have to tough it out while the renters makes other arrangements. This is about human beings here. If banks can’t deal with people it needs to shut down. Treating people like trash is unacceptable and the government needs to protect the rights of tenants.

    Here’s a good legal resource for answers about tenants rights in Ga. Brucie will be fine, he has Section 8 status. The government picks up his tab.

    Blubbering Badie could have pretended to be a journalist and actually passed on some salient information.

    *A tenant who remains on rental property after the owner, who is his landlord, has been foreclosed upon becomes a tenant at sufferance. The lease between the tenant and the original owner/landlord is terminable by the purchaser. If the purchaser wants the tenants to vacate, he must first demand possession of the property and, if refused, file a dispossessory warrant. *

    *The purchaser can choose to become a landlord, either by offering a new lease or accepting payment under the prior agreement. A purchaser at foreclosure who accepts rent from existing tenants has entered into a tenancy-at-will which can be terminated with sixty (60) days notice and which the tenant can terminate with thirty (30) days notice. *

    *A tenant residing in property that is threatened with foreclosed should attempt to contact the new owner or the attorney handling the foreclosure to determine if the tenancy will continue. If a tenant does not receive assurances of continued tenancy from the foreclosure attorney or the purchaser, the tenant may argue that the lease was terminated by the foreclosure. *

    No one needed Section 8 after Pappy Bush and no one will need it after sonny Bush leaves, a great time to buy a home.

    Quick figures, after Pappy left office,the deficit was -290.3 in billions, when Clinton left office it was +236.2 in Surplus, when sonny leaves, an est. a -410.0. Btw…that is per year.

    As for Clinton, he balanced the budget on the back of the military and was the beneficiary of the fiscal infrastructure put in Place by GWB #1 and Ronald Reagan. Of course, his spending (remember Hillary’s Universal Healthcare?) was reigned in by a Republican Congress.
