Gwinnett may collect garbage company’s bond over fee
Atlanta Waste Industries says it will charge customers an extra $23.50 when it leaves county

Gwinnett County has threatened to take Waste Industries’ $150,000 performance bond for allegedly violating the county’s solid waste ordinance by charging a demobilization fee to its customers.
The action came late Tuesday after fallout from the county’s new waste disposal and recycling program carried over to the County Commission chambers.
Atlanta Waste Industries angered customers this week when it announced it will charge an additional $23.50 for discontinued service when it pulls out of the county Dec. 31. Company vice president Mike Ingle said the fee is to cover benefits to workers affected when the company stops operating in Gwinnett.
It also will defray some shutdown costs. He said he may have to contract for help in collecting about 30,000 carts still in the field.
The county finance department responded by saying the county may call in the company’s $150,000 performance bond. A performance bond is issued by an insurance company to guarantee satisfactory completion of a project by a contractor.
The county is taking over waste collection in January and has tabbed Gwinnett Clean and Beautiful, the not-for-profit agency, to manage the program.
Two residents voiced opposition to the new solid waste plan at the county commission’s 2 p.m. business meeting. Commissioners Mike Beaudreau and Bert Nasuti defended the action.
Beaudreau said citizens were notified numerous times of opportunities to speak out about the proposal.
Mailings were sent out in utility bills and public hearings were held during the formation of the proposal, he said.
Nasuti called the demobilization fees despicable and constituted a breach of contract with the county. He said some 20,000 residences in Gwinnett County have no garbage service, and the new solid waste collection plan was needed to address these kinds of issues.
Allied Waste implemented the same fee in late September to its Gwinnett customers. Company spokesman Jim Zeumer said Monday most customers were understanding.
Under the county’s new plan, which includes expanded recycling, residents will pay $20.45 per month through June. Then the charge drops to $17.86. Yard waste will be $10 extra.

I have been irritated about this whole plan since its inception for many of the reasons listed above but I am furious today. You see, last Thursday (our trash day) Atlanta Waste came out and picked up our trash can. They said we should recieve a new one in a "couple of days" from the new carrier. Now we have a week's worth of stinky garbage piled up in our garage and tomorrow is supposed to be trash day so I called GC&B offices to ask when I might be getting that new can. Their answer? "We have until mid January." And AWI has stopped answering their phone. That means 5 weeks worth of trash.
So, if Atlanta Waste had any chance of getting $23.50 out of me they can hang that up. And I'm considering dragging their butts into small claims court over the 3 weeks of service I've already paid for that they are now not delivering.
Now my only question is whose front door I am going to drop my trash off at for the next 5 weeks, AWI or GC&B. I think I may divide it evenly and share the wealth.

I feel quite sad that I have lost my option to select my waster carrier. What's next, will they choose my grocer as well. Suppose your office lost a contact that held your livelihood, would you be angered by the company for losing or the organization that took the business. As citizens, I thought we would have some control, but in Lawrenceville....we have no options, our gas, water and now waste is controlled by others who chose for me. I don't have angered feelings toward Waste Industries for trying to pay their employees through the can pick up. It's not like a retail store that can have a going out of businees sale..... By the way, did you get a rate increase when gas was $4 a gallon, I didn't, and wouldn't have questioned a gas increase hike, but they stayed true with their billing rate. I am frustrated with Gwinnett/Lawrenceville and am sending my bill to:

When I got my bill with the added fee I contacted Allied Waste and made a verbal complaint only to be told they would not reconsider. I immediately dropped my service and had them pick up my containers. Yes the county finance department should call in the companyıs $150,000 performance bond and distribute the money to those who paid the additional cost.
However, I am really disgusted with the $2 million performance bond Gwinnett Clean and Beautiful required before being considered for the program. It takes opportunity away from small business trying to compete.

I too contacted both Waste Industries and our County Commission office. I informed Waste Industries that I was placing the deactiviation fee into dispute, please place that on my account as I do not have a contract with them for any service. They invoice me in advance for services and I pay for those services only. They lost in the bidding process and the items they want the county citizens to pay should be in thir COST OF DOING BUSINESS, not passed along to the customers. Call them and place the fee into dispute, pay the balance of the bill as they will render services for that part of the bill. Be sure to place it into dispute as that should put some time for the County to issued guidance on how it should be handled.

I am horrified by this deactivation fee! I have used this service for the 8 years I've lived here, never been late paying my bill and stayed loyal when all of my neighbors switched to a cheaper company. I WILL NOT PAY THIS FEE!!!!!!!!!!

It is amazing to me that a "not for profit" agency is running the show. The amount of recycled material will be increased providing a revenue stream for the contracted companies. Please tell me why the cost of the service is not less than the current price I am paying for my service.

Thank you for your thoughtful note regarding the additional fee to cover the cost of closing your office. I regret that I'm unable to pay you at this time. You see, I am still helping Circuit City and Bill Heard Chevrolet, and I am also expecting a large deactivation fee when General Motors goes belly up. I'm sure you'll understand.

What a bunch of trash!!!. This company made in sales revenue 10 million dollars last year. For the past year the rates have gone up on every bill every quarter from oil/energy charges to franchise fees. Mike Ingle, the rich get richer the poor get poorer!! Take some money out of your company and at least pay for the 100 people out of work. You have billed the consumer for every out of pocket expenses. I feel bad for the people being laid off, but this has economy has also affected my family too, and I'm not billing all of my friends and neighbors $23.50., so I can pay for cobra for my family. I did call Gwinnett county on the issue and they were very uncooperative, saying they did all the work to find the new companies. I'm now affective by the county making decisions for me and I'm having to pay for it!!

Personally I think it's Gwinnett County's repsonsiblility to pick up the tab for the account-closing fees charged by these companies. It's the county's fault the account has to be closed at all. I for one don't remember asking Gwinnett County to dictate my garbage service for me. I was just fine with what I had. Maybe Lorraine, Kevin, Bert, Mike, and Charles would like to pay for this out of THEIR pockets, since they voted for this mess.
