Saenz ran a red light and struck the side of a taxi, witnesses told police.

Raul Torres, Saenz’s passenger, was rushed to the hospital with serious head injuries. Torres, 18, was not wearing a helmet, police said.

Torres remains at Grady Memorial Hospital in critical condition, a hospital spokeswoman said.

Saenz was treated at the hospital and later taken to the Cobb County Jail, where he is being held on charges of DUI and underage consumption.

The crash remains under investigation.
