Clayton commission asks for investigation of DA

Four days after a former Clayton County employee under felony indictment killed himself, the Clayton Board of Commissioners Tuesday night voted unanimously to ask to the state attorney general's office to investigate the Clayton district attorney's office.

A resolution adopted Tuesday night accuses Clayton District Attorney Jewel Scott of "inappropriately" using her position to investigate people on behalf of her political supporters.

The board has criticized Scott's investigation into the alleged January 2006 theft of an American flag from a police memorial by Donnie Ray Hood. Hood worked for Clayton County for almost 20 years before retiring in October. Two days after Scott filed notice to seize Hood's retirement benefits if he was convicted, Hood shot himself at his Hampton home, police said. Hood was due in court March 31 for a trial on the charge.

"This is the final straw," board chairman Eldrin Bell said. "This board will not sit idly by and watch employees drug from their houses for the sake of someone's personal agenda. It's just not going to happen."

The vote and comments by Bell drew applause from about 100 people attending the meeting.

Scott, who did not attend the meeting, said in a phone interview Tuesday night she is comfortable with the attorney general's office reviewing the case.

"Provided they have jurisdiction to do that, they are certainly welcome to look into the case," Scott said. "We had a solid case against Donnie Hood."

Scott, who is elected to her position, said the commissioners' action was "rooted in politics and personal."

Hood family attorney Bill Atkins addressed the commission Tuesday night to thank them for their courage to honor Hood with the resolution.

The resolution read in part: "The members of this board, many of whom had known Mr. Hood for many years, question the validity of the allegation contained in the indictment presented by the Clayton County district attorney's office to the grand jury. ..."

Atkins said the district attorney's investigation into Hood has been "shrouded in secrecy" from the start.
