Will change of judge make a difference?

Superior Court Judge Hilton Fuller has removed himself from the death penalty case of Brian Nichols. What effect do you think getting a new judge will have on moving the courthouse shooting case forward?

Yes it will make a difference. Add three more years. Or bring in a Texas Judge.

fuller, in his quest to provide a fair trial, was completely stubborn in the eye of public opinion. his stance was built on principle, but the public has no tolerance for principle or the willingness to give one red cent to a man who is clearly guilty of killing 5 people.

excuse me. he killed 4 people and crtically injured one. the word alleged should never be used in this case.

NONE… What the Honorable Judge Fuller said is the TRUTH…

Only bleeding heart, tree hugging, no justice, liberals cannot see that the scumbag Nichols killed a judge, court reporter, Sherrif & unknowing FBI agent, in cold blood.. Was witnessed by hundreds & seen by hundreds of thousands throughout the US of A..

What more evidence does one need to hang the SOB?? Oh yeah, he’s crazy!! Well that’s his problem.. Not the tax payers..

Why isn’t this LOSER held accountable for his actions??

It will make a difference if it causes the state to allocate enough money for the defense. Otherwise, it will be the same problem.

Or, if they pick a judge who isn’t concerned about making sure that the judicial system in Georgia follows the Consitution—that would speed things up a bit.

I hope they don’t pick someone who’ll just turn the other way as judicial standards are lowered. People outside the south already think we’re unsophisticated and backwards and that we’d all lynch folks if we could get away with it.

I agree with the judge. We all know what happened; we saw it unfold and saw him end up someplace other than where he was. Duh.

That this case even needs to go through due process is ridiculous, but that’s the law and this bum/murderer is entitled to a defense. What a waste of our money. I don’t know why his parents couldn’t talk this kid into a plea. And while the DA wants the death penalty, take the plea so this case can GO AWAY. Like the judge said, we all know…

It’s TRUE everybody in the WORLD know he did it. I, think Paul Howard, should rescue his self. Paul, should accept Brain, plea for murder everyone knows by time appeals and everything finish he will not be excutued but die from old age so Paul, should accept his part and not put everything on the Judge.

I doubt this judge is stupid enough to believe that his comments were off the record. He reminds me of Britney Spears. She acts crazy so she won’t have to keep her children. Judge Hilton Fuller didn’t want this case so he made inappropriate comments. Smart move.

Everyone knows Brian Nichols is guilty. In order to give respect to the people he killed in cold blood we need this case moving and give him what he deserves! And, that is not the limelight which he currently enjoys!

OJ revisited. He did it. There is no denying it.

This is just another reason to elect a Republican into the White House - to stop the nomination of Liberal judges. It’s absurd how our legal system has been b******* by the Democraps, the ACLU and their willing accomplices in the news media (including the AJC).

Claire can we get off of OJ? Many a guilty white man has gotten off because they killed a black. And you have no proof that he did it. According to a group of his peers, he’s innocent!

Brain Nichols is guilty as heck and should be given the death penalty. See, the difference is, we know he did it. There were actually witnesses. Will white America ever get over OJ? Here’s a good way to help you move on…talk to the elderly in your family. Surely they were involved or knew someone involved in the killing of a black man just because he was black. And with the number of black men being released from prison daily because they didn’t do the crime, well, let’s just say that if OJ did it, that’s one black man not going down for what hundreds of white men NEVER went down for! Truth Hurts!

Wouldn’t you hate to be the one person everyone knew was guilty and was denied due process of the law, only to be innocent.

I’m not saying in any way that he is innocent, but if we forego the rules of justice in one case, what would prevent us from doing it in the next case where everyone knew the person was guilty, but he really wasn’t

Judge Fuller was clearly trying to create a lavish case for him to preside over. Pushing his own ego at the expense of the taxpayers. His final comment only confirms his incompentance.

How many judges actually give interviews to magazines and write letters to the editorial staffs of the local newspaper while presiding over an active case? This case was all about judicial ego.

The best way to avoid the death penalty-don’t commit multiple murders in public. Judge Fuller let Brian Nichols and his team steal the taxpayers money-no amount of money can get you off for what he did in public. Somebody needs to kill his a* in jail and save us the money.

Wow Blackgirl. You have a lot of resentment and a horrible attitude. You are the only person to bring up race. It is sad that you think it is okay for anyone (black or white) to get off because of their skin color and something you percieved happened to other people. Let one of your family members be murdered and the killer go free and then let’s see if you feel the same way. OJ was found not guilty. Different from innocent.

To John : January 31, 2008 8:56 AM

I understand your feelings, because I had a relative shot in the back and killed. NO death penalty. Its like Jana- January 31, 2008 9:01 AM, There are people who do not want the death penalty. Jana’s remarks does not apply to this case but she has such an agenda she would make them. Those defending this trash believe if the price tag of defending him is so high it will get plea bargained to life. This is a hidden agenda. But if you want to give this trash life, remember what our President said that the government will take checks or money orders. Jana, plese send them often. In matter of the judge, he needs to keep personal statements out until the case is tried.

William, I think you misunderstood my point. All that I am saying is that everyone, even this scum deserves a trial before we fry him. Because if we forego the justice system because we know someone is guilty, it will only hurt the innocent person who everyon believes is guilty. Yes, this is taking too long, but that’s our overworked, underfunded justice system. Do I think his defense needs millions of dollars, definately not.

I am in favor of the death penalty, after a fair trial and due process. That being said, I do not think it should take 10 years for someone to receive their punishment and I think the amount of appeals allowed is ridiculous. But everyone, no matter how guilty, should be tried before we fry them.

Justafan you mistake facts with resentment. My attitude? Get a grip? The fact is many a black man has been erroneously incarcerated because they were black. Because we all look alike. I am disgusted to continuously see black men being released from prison after spending 20+ years of their life in prison for a crime that did not commit. Have you been watching the news? Where are the white men being released for crimes they didn’t commit? In America, it’s ALWAYS about race. What country have you been living in?

OJ was found not guilty, period. For me, that means innocence. Where is your proof he commited these crimes, I ask again? And I reiterate that he is ONE man that SUPPOSEDLY got off for killing a blonde-haired, blue-eyed white woman and her lover! And for the record, my family members have been murdered in high numbers and not one WHITE man went free. Instead, they had a picnic and a community meeting and laughed about their lynching. These are not “other people” as you suggest. Darlin, I’m black. It happened to all of our family memebers. If the facts bother you, good. My own father tells the horror stories of growing up in the South and how blacks were treated as sub-human. He’s 65. The truth may hurt, but it’s still the darn truth. Deal with it!

Yes everyone deserves a trial, but what is clear in this case is that the defense’s strategy is simply to drive the cost to high, thereby having a case that the state did not do enough to defend him. What could possibly cost all of those millions of dollars that actually will contribute to his defense. You gotta hand it to them though, get the death penalty off the table by paying yourself too much what a gig

Hey blackgirl,

drop the race crap, really. OJ is not guilty, he may have done it, he may not. He didn’t get off because he was black, he wasn’t tried because he was black. Yes, pretty much the whole US is sorry for slavery (though i shouldn’t have to apologize to you, and I won’t, you weren’t a slave).

However, how can America put race issues behind if blacks keep bringing it up?? And the facts of the past do bother me, if i were alive then I would have tried to stop those things, they just weren’t right.

But the past is the past and what’s done is done..GET OVER IT AND MOVE FORWARD!! No one owes you anything, America made a freaking mistake, and it was a bad one. If you keep looking back, you can never look forward. And don’t bring up ‘facts’, because there are facts about the demographics of prisoners in prison…and i can throw those into the fray, too.

Blackgirl. YOu are not worth arguing with. You have a very skewered opinion. I agree that people should be set free if they did not commit the crime. BLACK OR WHITE. How far back do you want to go? Lynching your family members? Your attitude is why people can not move forward. I agree it is always about race. That is because people like you make it that way. Not guilty does not equal innocent. Look it up.

In my opinion, Judge Fuller had no business discussing the case (his feelings or opinions) with anyone until the total completion of the case (trial, sentencing or plea). This would be his instructions to the jury had one been chosen & seated. On or off the record, his comments & opinion are totally inappropriate. Second, his dismissing of the original four Public Defenders was too inappropriate. While Nichols is entitled to a defend himself, the law doesn’t state he’s entitled to receive his Defense from some world famous, death penalty lawyer from NC. He’s entitled to representation from the staff in the Public Defenders Office. Again, Judge Fuller in trying to be fair allowed his opinion and ego to cloud his judgment. As for Pompano and John, very stated I couldn’t agree with you more. Blackgirl you’re a mean one.
