Should Nebraska fan get hammered for internet hoax?

Yesterday The Daily Oklahoman newspaper and one of its sportswriters filed a 10-count civil lawsuit against James W. Conradt. And for one of the few times in our history, university athletics programs around this country are pulling for a newspaper to win one in court.
In case you hadn’t heard, Mr. Conradt, a 36-year-old Nebraska fan who happens to work in IT at the University of Texas, decided to strike back at some Oklahoma fans who were saying unflattering things on a Nebraska message board. His response to this unforgivable outrage was to write a bogus story that two Oklahoma football players — Sam Bradford and Landry Jones — had been busted for cocaine distribution.
To make the hoax look real, he allegedly lifted the template from The Daily Oklahoman website AND used the byline of Jake Trotter, a writer for that newspaper. Conradt then allegedly put a link the work of fiction on his personal website and on a message board.
Needless to say it wasn’t long before all hell broke loose and Mr. Conradt was forced to take the story down and apologize to the entire world. “I didn’t want to hurt anyone,” he would later say. Apparently accusing someone else’s child of cocaine distribution is what passes for humor in Mr. Conradt’s world.
I’ve read comments on this story that go something like: “Well, yeah. What the guy did was dumb. But hey, it was a joke. Let him apologize and let’s move on.”
If you’re in that camp, then you don’t realize what has really happened here and what is about to happen.
Now understand this. I work for a newspaper so I’m a Free Speech, First Amendment guy. I have no problem with people expressing their opinions. It may be rough and it may be cruel and it may even be uninformed, but you have to live with it in a free society.
But to publish something that is knowingly false — to accuse someone of a crime for your own amusement — crosses a line. To violate copyright laws, trademark laws, and put some one else’s name on your bogus story crosses a line. In Mr. Conradt’s case it was a pretty clear legal line and he’s about to pay a very dear price for it.
Here’s why this case is important. Because of the freedom of the Internet, some people are lulled into believing there are no rules and no accountability. Some people believe there is one set of rules for sports fans and one set of for everybody else. This case will prove that is not true and that is why I expect the Daily Oklahoman and their lawyers to make an example of this guy.
Trust me when I tell you that there are a lot of college athletics departments who have a tough enough time dealing with the TRUE stuff that is posted on the Internet. But they also spend a lot of time having to shoot down and disprove things that are not true that are written by people who view hurting others as a form of sport.
These schools won’t say so publicly, but they are hoping that Mr. James W. Conradt gets hammered in the court of law and the court of public opinion.
Am I wrong about this? Is this just not that big a deal? Should this guy get a slap on the wrist? Hasn’t the public humiliation been enough punishment?

You are right on all counts. The Internet is a strange medium but the rules that govern responsible journalism should apply there as well. Conradt’s freedom of speech doesn’t give him the right to hijack the news business in the name of “retribution” to the Sooner fans.

There isn’t a lot of difference between what he did and the inflammatory half truths that Terrence Moore writes every week. They should both be held accountable, Conradt for breaking the law and Terrence Moore for being a stupid jerk.

You are very correct. It has just gotten so easy to accomplish such schemes and the results of poor judgement can be expensive. I do feel for the guy, but just like any situation we can’t let our emotions get ahead of better judgement.

Welcome back, Tony……I guess this means that my self-imposed sabbatical is now over as well.
On the other hand, however, who gives a rat’s @$$ about some delusional Nebraska fan? Although I am a UGA guy, it kinda reminds me of the time when, right after 9-11, the silly-@$$ed UGA fan refused to comply with airport security when he was on the way to see the UGA/Ole P** game and was subsequently led away in irons for his trouble. The obsessiveness of some fans amazes even me.
The question I have is this……why aren’t those athletes who were slandered filing a major lawsuit as well? Their reputations suffered, their families probably thought their loved ones were in jail and in major trouble, and I am sure their coaches blew a gasket when this falsehood hit the internet. I know I would be looking to sue someone’s @$$ off for this outrage. Why aren’t they?

I cannot understand how anyone would fail to see that what this guy did was not only illegal, but completely morally and ethically disturbing. To accuse two innocent young men of such a heinous crime is not a laughing matter. I hope they throw the book at him. Let him be accused of the same thing and see how he likes it. This guy is my exact age, and I feel light years ahead of him in maturity level. He should in no way be allowed to get away with using someone else’s byline either. And all just because of negative comments about his team on a blog! Do what the rest of us do, and suck it up. That’s the nature of being a sports fan, seeing what inane comments your rivals will say about the team you follow religiously. He took it to way too far an extreme.

Haywood, It is my understanding that the parents of at least one of the athletes is very much planning to file a major lawsuit. Mr. Conradt has a very long row to hoe ahead of him.

The athletes are the ones with the more serious lawsuit. Clearly they were libeled and defamed.
If I were Mr Conradt I would be less concerned about any lawsuit a newspaer brings. There would be copyright infringement but the newspaper is protected from damages arising from a blogger so they could not claim liability from that.
Newspapers mischaracterize others as a matter of routine, which makes it problematic to assume the high road in this case. Just last week Moore labeled Georgia football players”knuckleheads” and called for their dismissal even though they have not been convicted of so much as a misdemeanor. Another example? Last year Carter Strickland characterized Clifton Geathers as being mentally slow. How AJC could tolerate that kind of description of an African American athlete struggling with a learning disability is very disappointing at best.
We’ll see how the suit plays out, but the athletes clearly have a case. What they probably don’t have is a solvent defendant

Hah, Haywood. I remember that UGA fan at the airport that caused all the delays for everyone else. My older brother, another huge UGA fan, was at the airport that day waiting to board. He was delayed for a wedding. I was ashamed of that idiot that held up the flights. Way to go, moron. Didn’t they ban him from attending games? Too bad this Conradt can’t be banned from attending Nebraska games as well.

It would only be fair for this guy to forfeit every penny he has and every asset he owns to those players. Then he could start a nice 3-5 year stint in a correctional facility. People who have grown up with a feeling of invulnerability because of the anonymous nature of the internet need to be shown, graphically, that your actions ALWAYS have consequences.

Reality Check, I hear You on the solvent defendant. Being awarded a judgement is one thing, collecting it another. A Person that dumb is probably not solvent. Every day on these blogs athletes from one school or another that have not been CONVICTED of anything are called “criminals” and “thugs” by people that have never even met Them. Be underage and get caught with a beer, You are a thug. Pass on the right on a Mo-Ped, for cripes sake, you are a thug. Have a pocket knife in You room with a blade an inch too long, or a legal handgun in the wrong place in Your car, You got it, thug! You can be like the notorious LSU QB and not be arrested for anything, and still be a thug. The last time I looked a surly attitude is not against the law. Neither is celebrating a victory by dancing on the sideline. I think that in nine cases out of ten a thug is some kids that plays football at a school One doesn’t like. If this case will make some people be a little more careful with what They post on the interrnet it will be worth it.

Perhaps he should get the same penalty that the person involved in the false letter about George Bush’s National Guard Service received. They all lost their jobs but no criminal or civil penalty. Or perhaps the same rules should apply as those to the AJC in the Richard Jewell case. Was “malice” involved? Needless to say the reporter has nerve in judging himself as the “injured” party. I can see the newspaper protecting their “intellectual” property but the reporter has no reason for a lawsuit. Wasn’t this the newspaper that questioned the “intestinal fortitude” of an Oklahoma State quarterback?

To post on these boards is a privledge, not a right. We all hope that correction will be presented to Mama Cox at the next ajc company picnic. The difference between the name callers here and what Conradt did is a wide chasm. Taking, borrowing or stealing the template to make a falsehood look real is part of his deed. Hellsbells, many of us posters have had our good names dragged through the mud, our tag identities stolen and misrepresented by some posers wishing to inject ire and incite a written riot. Oh, so right, Tony! Conradt should be hammered HARD, OFTEN, and LONG! His actions were reprehensible and irresponsible. He has attempted to hurt someone without cause, and this hurt may continue long after the story falls from the spotlight. I HOPE that Mr. Bradford and Mr. Jones are merely waiting to see the results of the Daily Oklahoman suit, then pounce! Also, there are some things that we should go out of our way to protect, and our rights of free speech are easily in the top five. With so many opportunities around that erode away our rights, we don’t need short-sighted idiots making fodder for some other idiots in Congress to begin to shout about how we ‘need to control this here Internet thing’!! But the potential damage to two young men is the worst, and I do hope that they hammer Conradt ‘till he pees blood!

I agree Shane about how offensive it is to label athletes as thugs for no reason. This suit won’t stop critical bloggers. Many suffer from low self esteem and they will criticize anyone who is successful.
I don’t like it when bloggers criticize athletes - anybody’s athletes. I was one myself back in the day and I understood the critics were people who weren’t capable of doing what I was doing. Some things never change. Low self esteem critics are prevalent in the business world and life in general too.
Tony, what does the newspaper’s complaint allege and what relief do they seek? I can understand a restraining order and copyright and trademark infringement, and the writer has a case personally for using his name. What else is the newspaper’s complaint about?
Tony to borrow from what you said, there are a lot of people out there who believe there are one set of media rules for athletes and one set for everybody else. There are also a lot of people out there who have observed that there are those in the media who “…view hurting others as a form of sport.” You put that really well and I am not directing that comment at you. I enjoy what you and Chip do. You have colleagues who are much more complicated to like.

A little give and take with those from other schools is fun, but, unfortunately, there will always be some who can’t crawl out of the gutter and take things too far. This reminds me of when Steve Kerr was a freshman playing against Arizona State. This was only two days after Kerr’s father had been assasinated in Lebenon. Some of the State fans taunted Kerr with shouts of “Lebenon” and “PLO”. There is no way any fan of any school can accept that level of pure crap (or s**t).

Gen, I found this definition of Libel on NOLO, a Legal definition site. Libel- An untruthful statement published in writing or through broadcast media that injures the Person’s good name or standing in the community. Libel is considered a tort and is a basis for a Civil suit where said Person can collect for damages. When the defimation of charachter is oral it is considered Slander. The Father of one of the Boys has said that he is suing. He stated that He had “deep pockets” and would persue this suit to the end. One example of people crossing the line, when Tripp Taylor got into trouble last year I read several posts on the AJC blogs that said He had physically assaulted a couple of teenagers and urinated on Them. Taylor was never charged with doing either. He was charged with “Verbal Assault”, whatever that is. The “Verbal Assault” charge was later dropped. Sounds like Libel to Me, but had a suit been filed that would have been decided by a Judge. The moral of that story is that unless You actually saw an offense take place don’t accuse anyone of it. If You saw a criminal act don’t post it on a blog, go to the police. Is insulting a rival team worth having Your financial future decided by a Judge?

shane #1 - assault and battery are often misunderstood terms. battery starts when a person makes physical contact with another person. assault is threatening or creating fear. physical assault may be raising a fist to strike; verbal assault could range from generic yelling at someone to quietly stating that you intend to attack them at some point.

Seriously…Let’s attack those that say the apocalypse is next week for inciting hysteria! this wouldn’t have been an issue if the radio station hadn’t picked it up and run with it. dumber stuff is posted on blogs/message boards all the time. this is just another case of the mainstream media not knowing anything about sourcing and fact checking. in fact, any worthwhile blogger with a bit of url tracking and scrutinty of the template used could easily tell that it was a fake. if this kid is prosecuted, so them should the msm sources that aired the story.

The question I have is what constitutes libel in the written form. If someone gets “published” on an internet blog of a credible news source, does that constitute libel. Here’s an example of what I’m talking about from Chip Tower’s June 30th blog:

Now, this to me can be damaging to young men’s reputation as well. So do we need to police what makes it onto the internet via a credible news source like the AJC?

Well, these two players are someone’s children. As mentioned, the father of Landry Jones has stated publicly that he will make Mr. Conradt pay for his deeds legally, and that he has “deep enough pockets” to make sure it happens.
Mr. Conradt may be broke beyond all belief by the time the lawyers for the newspaper and the players’ families get through with him.

What constitutes Libel would be for the Court to decide. That was the point of My last post on the subject. Why run Your mouth and risk being sued? At least the “Big Bad OL” was not named. Tripp Taylor was, on several posts. I would not be suprised if the Conradt case sets a precedent involving what is posted on blog sites. One thing is certain, when people will not disciplin Themselves, the Courts will do it for Them.

GATORZONE, UGA is being “hyped” while UF is “flying under the radar”? Are you serious? Maybe on this post you have more UGA fans “hyping” the dawgs, but I’m certain more Florida papers have an even greater amount of Gator hyping. UF, and their coach Urban “Legend” Meyer, are the most hyped thing going in college football. Since he’s so great let’s examine his record:
YEAR 1 (2005) Record: 9-3 Memorable Moment - Urban “Cryer” boo hooing at a post game press conference after a loss to LSU. He later assured everyone things would get better when he got the type of players he needed for his “system”.
YEAR 2 (2006) Record: 13-1 Memorable Moment - winning the NC. Congrats. I was rooting for you because I didn’t want to see OSU win. Did the “Legend” suddenly attain all of his “system” players in one short year? Doubt it.

What were Urban Legend’s excuses? A “bruised” shoulder perhaps?
Face it, you have a 9-wins-per-season coach in the Legend. That may be great for some colleges, but for the flagship university in what is arguably the best state in the country for producing top notch football talent, continual 9-win seasons will not be acceptable to the Gator Nation.
Get a grip and read as many articles you can on the upcoming season. I’ve read more hype on UF than I have UGA. But in the end “hype” never scored a touchdown, held its ground on a crucial 3rd down, held an opposing RB to under 184 yards rushing, or kept its QB from having his butt planted on the turf six times in a game.

Coach Urban Meyer (referred to as CUM) is one of the BIGGEST whiners in all of college football. If the Gay-ters are flying under the radar, then my name ain’t Iron Mike (well, it’s not actually). They’ll definitely lose to the Dawgs again (and they’ll learn to love it because it’ll happen for years to come). I think CUM will have a lot of problems this year with some of the younger players and he’ll might even finish behind the Vowels. Ole Fat Phil might get a few nice wins under his belt this year. I know he’s on the “hot seat” but I think UcheaT is the one actually flying under the radar. My prediction is a Georgia-Auburn SECCG this year. Go Dawgs!

Chief i will refrain from making a prediction, but will say that OU will be favored in every regular season game, and if they make it, the conference champ game. So i definitely like their chances. but theres always the unknown injury factor,etc. the big12 will be tough, with the best talent and depth at QB that i have seen in a conference with QB’s returning from 7 of the top 22 scoring-offenses in the country. Texas QB Mccoy was the big12 freshman player of the year 2 years ago. now he’s not even on the radar behind heisman candidates daniel (Mizz), bradford (OU), and harrell (TT). several other big12 QB’s are on pace to break school records. according to EA, your dawgs and my sooners will be playing for it all :-)
