10/12: Trooper’s side of Cindy’s alleged DUI

Through Georgia State Patrol spokesman Larry Schnall, I finally got information from the trooper’s police report regarding Star 94’s Cindy Simmons’ arrest last Thursday night in Buckhead. Up to this point, I’ve only gotten Cindy’s point of view, which she told on the air Friday and I repeated portions of what she said on Monday.

The trooper is Stacey Collins. He’s part of the Georgia State Patrol of the DUI Enforcement Unit funded by the Governor’s Office of Highway Safety. He was recently named trooper of the year for DUI enforcement.

In the police report, he said he was driving behind Simmons, who was in a BMW on Sardis Way at 11:53 p.m. October 5. (That’s near the Roxy Theatre.) She made a wide right turn onto Roswell Road without using her turn signal at the stop sign. She also didn’t make a full stop so Collins pulled her over. He said she was very polite and apologized for not stopping completely at the stop sign. He wrote that he detected the smell of alcohol and thought her eyes were bloodshot and watery so he requested she exit the vehicle.

She acknowledged to him she had been drinking that evening. He gave her some sobriety tests, including one leg lift, walking in a straight line and the “follow the finger” procedure that law enforcement calls Horizontal Gaze Nystagmus. The report does not say how she did on those tests. She said on air she thought she did fine.

He wrote that Simmons said she had two margaritas that night but wasn’t consistent in terms of when she drank them. Simmons on air felt she was not impaired in any way but did not say anything about when she had her last drink or even what she drank.

Trooper Collins said he requested she do an onsite preliminary breath test but she politely declined. He said he read her her rights, a procedure which includes offering the option of going to a hospital to have an unbiased blood alcohol test taken, but she didn’t pursue that option. Schnall said the incident was videotaped but the tape won’t be released until the case has been heard in court. Schnall said she can continue to drive with a temporary driving permit until she goes to a hearing sometime in November. The hearing, he said, determines if the trooper followed DUI arrest procedures. If the administrative license suspension (ALS) is upheld, he said, she would automatically lose her license for 1 year because she refused the DUI test under the implied consent law. He said trooper Collins had a 100% conviction rate in 2005 for DUI.

I’m with you apd5453, who cares? But something does amaze me about another aspect of this, well not really. The pic everyone saw in the paper was obviously not the mug shot taken at the police precinct.Why? Do you think if “Ms. Cindy” was a darker sister we would have gotten that nice photo? Think not. She’ll get a slap on the risk, and that will aslo be news…and again who cares?!

The State Patrol should stick to patrolling our Interstate Roads and stop ambushing the city streets. Ever see them around the city during the day? No, they swoop into Buckhead and Midtown to fill their monthly ticket quotas by pulling over anyone they can. And they will pull you over for anything they want. A wide turn? Gimme a break.

Get her and all other drunks off the road. If you’re not drunk, take the test. Refusing the test is admitting guilt. I know a lot of other drunks will disagree, but I don’t care. Keep drunks and 16 years old in daddy’s Mercedes off the road, if they want to kill someone, let them kill themselves.

Who says the trooper even knew who she was? She didn’t tell him who she was either. And you think it’s a racial thing?! What a crock. I have listened to their show since they came on the air a few years ago. Yes, they can at times be a bit irritating and at that point I either change the station or put in a cd. I personally don’t think anyone should drive after having even one drink. Everyone thinks they’re okay to drive even when they are not. Why not let the courts handle this one? None of us were there to see what happened and we certainly can’t judge on what think happened.

Yes I am serious, and of course I go out with friends or my husband occasionally, although not at the frequency I once did before kids (can you say sacrifice or better yet having your priorities in order?!?), and certainly not until midnight, as I value putting my child to bed and the cuddle time that goes with it, however, somehow I am able to do that without putting my life or countless others at risk by driving under the influence. If that makes me ignorant and judgemental in your eyes, then I simply cannot go on living…oh wait, I don’t care!

The “darker sister” comment was made because Porsche Foxx’s arrest less than 2 years ago had mug shots in the paper, not a publicity photo. Before you accuse someone of being an instigator or race baiter, perhaps you should discover if they are telling the truth.

I don’t think I’ve ever heard Cindy on the air - so I could care less whether she’s good or bad on air - but after reading this blog, I do feel sorry for her. First - this could happen to anyone. I would NEVER condone drunk driving, but the trooper’s report confirms she wasn’t doing anything that was dangerous or reckless, swirving, weaving, speeding, etc. She’s still got to deal with this and pay the piper. Secondly — this could happen to anyone. But because she’s on the radio, and because there’s this blog, all you chumps with axes to gring against the world get to chime in with mean and nasty and usually insidious comments, and do it anonymously. What a treat for the simple minded among you!

I think I’ll stick with The Vent when I need a mindless diversion. At least those anonymous comments are intended to be funny, and someone gets to screen them before they get published.

I never claimed to be non-judgmental, just pointing out the hypocrisy of someone mis-judging someone else as judgmental.

My kids are lucky - Thank you for the compliment, but more importantly I am lucky that I have them and do try to live every day for them. Does that mean I don’t make mistakes? Certainly not. But there are some things in this world that are no-brainers, and for me not driving after drinking is one of them. In your world that seems to mean I don’t have a life, to which I say that must mean yours is pretty empty. As for my spelling skills, well, at least mis-spelled words don’t kill people.

She didn’t do anything hazardous? she made a wide right turn and blew thru the stop sign, a conscientious officer, who specializes in DUI, observes these indicators of possible impairments, stops the driver and confirms his suspicions and arrests the driver. Instead of being glad that she was taken off the road, some complain she didn’t do anything wrong, amazing, I guess some have to wait until she blows threw another stop sign and runs someone over before they care and take DUI seriously.

Stupid woman. How does she know if she did fine on the horizontal gaze nystagmus sobriety test? You cannot tell anything. We all have nystgagmus, which is involuntary jerking of the eye. Alcohol intensifies the effect of the jerking, making it visible.

The officer looking can tell, the more your eyes jerk prior to moving 45 degrees away from the center and back and forth, is SCIENTIFICALLY PROVEN as an indicator of alcohol impairment. “The more jerk, the more drunk”.

State law requires you to submit to a breath test, she “politely” refused”, as she said that is what she had been told about taking such tests. Stupid.

She will probably get one of those high priced lawyers like Stein or Head, who make a living getting people off on technicalites, so minor that it is stupid. They probably called her first thing.

I have no sympathy for her. I am a former police officer who patrolled for 14 years. I have seen what DUI does on the roads. DUI should be a felony, with a one year prison sentence for the first conviction, no execptions, no time served, etc. Take people’s cars too.

All, The cops do take the DUI thing to far sometimes. I got pulled over in Gwinnett County for not maintaining a lane on I-85 at 1:30am. I was asked if I had been to a local concert and said yes, how many drinks did you you have, my answer none. I had just left WAFFELE HOUSE! I had my wife and two kids 19 and 21 years old with me, and had not had a drop. But because I was driving my kids sporty car, adn we were talking and having a good time I get pulled over for DUI? I volunterred to take the breathalizer test, but I don’t think it would register bacon!

I think that all the cops should just go sit at the donut shops because thats all they are good for according to you people. The next time you get into an accident with a drunk driver dont call the cops call george stien the dui lawyer and see if he helps. You will be greatful for the cops when u need them but when you dont they are a pain in the ass, RIGHT!!!! You people need to grow up I dont care who or what the woman is if she was driving under the influence then she needs to go to jail. You people supporting her have apparently not lost a loved one to a drunk driver. Maybe if you had you would feel different. I’m sick and tired of hearing about officers not being respected. They do a lot for society and deserve all respect. Of course there are a few bad ones like in every job. But the good ones make up for the bad ones. I agree with you reality. In this city cops are worthless. I had my car stereo stolen in broad daylight while at work in midtown. I called the police and they said that I could file a report for my insurance but they were really not going to be able to do anything as far as recovering my property or investigating the robbery, then I waited 2 hours for a cop that never showed to do my police report, when I finally called back they told me just to come in and fill one out, the cops were busy…DOING WHAT? Giving out tickets for traffic violations! give me a friggin break…I would much rather my property be protected and real crimes be pursued than worry about someone rolling through a stop sign!

Have you ever even driven in the ATL…folks are dying left and right because of idiot drivers and you want them to come and fill out a report for a cry baby that lost his stereo.

In 2005 more than 42,000 people died on the road. In 2004 the same # of people were killed by drunk drivers as were murdered but it’s not a big deal to you because you left your stereo out and want someone to hear you go one and on about what a victim you are.

Believe me, IT DOESN’T PAY TO DRINK AND DRIVE.

My daughter got a DUI in Gwinnett County last May driving on I-85. It resulted in her loosing her job (which pay extremely well) having no license for a year, 40 hours of community service,$1800.00 fine,12 weeks of group therapy for drunks(as they call it)72 hours in jail and a fee for her attorney. Now she has to work 2 jobs to pay for her home, utilties, car and food.

Some DUI laws are way too strict, how do they think a person can continue living when they have no means to get to and from a job. It would force most people to file bankruptcy.

Folks, keep in mind she committed a traffic violation and was pulled over for it, be it was a probably a minor infraction in the big scheme of things, and she could have possibly got off with just a warning. Alcohol smell was detected by the officer and she admitted to having a couple drinks before driving. How many times have we all heard that even ONE drink can impair a driver. She needs to face facts, she got caught for doing something she should have known was wrong. Let her pay the consiquences..Case Closed.

I think Cindy needs to get help for her problem. It’s such a shame to see a good person controlled by the bottle.

She needs to acknowlege her problem (like Mel Gibson) instead of downplaying it. It looks real bad that she refused the test when all her other friends TOOK it. That and she was obviously disoriened and confused about her drinking that night.

I know a few months in a program will clean her up and allow her to hold her head up high in society again.

I feel deeply for the shame and embarassment she has caused her family and pray she will get help and get right with God and her family.

Don’t admit to drinking anything if stopped for any reason ESPECIALLY DUI. You quickly take the burden of proof off the state if you say you drank earlier. They make it seem so casual during the traffic stop to ask if you have been drinking. Get a good DUI defense attorney and let them handle it.

She should have just taken the tests if she was that confident that she had not had much to drink. Now, look at the jam she is in. The police are out late at night patrolling Buckhead because that is where they will find the drunks. There’re not trying to meet their quotas. They are trying to protect us and get the drunks off of the road. You don’t find too many drunks at 2:00 in the afternoon. As my grandmother always said, “nothing good happens after midnight.” If she had taken the sobriety test I may feel differently about this but I think declining is admiting guilt. However, I agree. Who cares? I love Ray but I turned them off awhile back because Cindy has decided that “umm” is a word in the English language.

APD may be thugs (or maybe not, who cares), but this was a GA State Cop that pulled her over. He smelled alcohol. He gave tests that led him to ask for a breathalyzer, and she refused (what, she listens to Stein on the Regular Guys?!). She got charged. The same thing could happen to anyone, and they’d probably not get off (unless Stein is as good as he says).

Now, judgements of her parental responsibility due to being out at midnight is stretching it a little. As far as being disoriented and confused, hey, tune into Cindy and Ray on any afternoon, she’s always disoriented and confused! Dumb as a box of hair, I declare… irritating as hell in that regard. Case in point: she made this a topic on her own radio show the day after! Doh… bet that made George Stein wince…

I wasn’t able to make it out of the house until 11pm so, so what if I didn’t make it home until 2am. You are an incredibly judgmental and ignorant woman, and I’m glad you aren’t my mother.

Don’t belive me read this news paper and watch the news on any given day, better yet ask that Judge, court reporter or any anyone else down at the court house during Brian Nichols rampage. JAMES - stop ambushing the city streets? Get real…where are all the bars? THE CITY…where do these drunks get into their cars …THE CITY. I don’t care where you are, if you’ve been drinking, don’t drive. It isn’t rocket science. Maybe if the police had stopped the jerk who was smashed out of his mind and driving his daddy’s SUV around town, he wouldn’t have hit one of my friends head on and almost killed him. Never mind that my friend was ON DUTY and is an ATLANTA POLICE OFFICER…and this drunk driver decided he wanted to run a light and ruin Rick and his family’s lives forever. Yea…good idea..stick to the highways because of course, no one drives drunk in the city.

Any given weekend the suburbanites trail into the city to get their drunk on. You can watch them flow into the city into Buckhead and you can watch them float home to Gwinnett, Cobb, etc. I’m smart enough that if I am going to go out with friends and have a couple of drinks I either walk or take a cab. I do not drive.

Drinking and Driving is a bad choice.

But, having said that, I do like Cindy and appreciate her willingness to cooperate and address the issue on her talk show. However she was quickly shushed by her management to cease talking about it for legal reasons.

She is a real sweetheart folks, who loves her family and is a proud new mom. She does not have a record of this before, so how can we accuse her of being someone with “a problem?” Bad decision.. certainly.

I think people just love to pounce on the famous and bring them down.

Lets not forget all the community service and charities that Cindy is involved with. I know that she regrets this, so lets give her a freaking break.

Isnt it odd how all the other negative subjects of racism etc come out in forums like this? Get over yourself ATL.

We forget that when you drink and drive you are at risk of killing or injuring someone. It is not an accident when you kill someone after drinking. Just look at all of the innocent people that have been killed in drunk driving crashes on the MADD Georgia website.

Don’t risk driving even after one drink. You could kill yourself or someone else. Even if you don’t kill or injure anyone just think of the public humiliation, a possible criminal record and all of the money you have to pay in fines and legal fees.

My comment about Gary McKee was unintentionally negative. What I was trying to say is that, these people’s public personna and their REAL personna may not be the same. Just because Cindy gets a DUI doesn’t mean she is a lousy bumbling no talent idiot. I liked Gary McKee and listened to him from the time I was about 14 until he went off the air at a time I must have been about 30 or so. I NEVER missed his show and only regret that I was never able to chat with him personally.

A couple of things I want to say here.

Are you serious, or just really lost in your hatred of others. She already has had this DUI reported all over the Atlanta papers and web site, which is more than 99% of the drunken slobs that do much worse have done to them. I certainly don’t condone drinking anywhere other than the place you will be sleeping it off, but to say she is getting lenient treatment is ridiculous. Everyone that knows her now knows about this, and there is no hiding it. It’s not like first time offenders really get hit with that big of a sentence anyway, especially considering how easily they could have killed someone by operating lethal weapon like a car while under the influence.

2) The mug shot thing is ridiculous. I think it is obvious the paper would LOVE to post the mugshot if they had it to post. They probably didn’t have it at the time. The only possible reason for them to withhold that picture would be if the person worked for an affiliated company.

I find it interesting that if a “citizen” does not use a turn signal it is a violation, but yet MANY police enforcemnt officers do not use the turn signal either. Do as I say not as I do? If not using the turn signal is a reason to pull a person over then most of Georgia drivers are breaking the law and ignored. I SEE IT EVERY DAY!!!! True- do not drink and drive, but if a police office is making a DUI suspicion on lack of turn signal use then 99% of Georgia drivers are DUI suspect.

Thank you “whatever” The friggin pigs in town don’t use turn signals, use their lights to go through red lights, sit around on their pig butts talking on their personal cell phones. They speed through neighborhoods, they contually violate traffic laws, I even saw one on Ponce drive up on the sidewalk to get around a back up! This city needs to clean house and bring in a whole new force…I would gamble that one out of eight would even be salvagable. The test could be simple just have them correctly pronounce the following words: ask, orange, and sausage. Then ask them what they call the man who fathered a child…if they answer ax, orhanch, sorsige and baby daddy—-fire them!
