10/7: Star’s Cindy arrested for alleged DUI (updated)

Cindy Simmons, the afternoon cohost with Ray Mariner on Star 94 since 2003, told listeners Friday that she had been arrested for an alleged DUI last Thursday night. Here’s a link to the story
Cindy, who has myspace page, responded to my email with the following: “Thanks for your email and for inquiring about my situation. Yes, I did discuss it on the air this past Friday and covered everything. At this point, I’ve been advised not to discuss it any further.” That doesn’t help me much in terms of solifying details since I don’t have the audio from Friday afternoon and she doesn’t seem to be addressing it anymore on the air today. On her Cindy’s diary on star 94, she only alludes to the situation by writing “It’s been a rough last couple of days and I just wanted to thank everyone for their support.â€? and “This too shall pass.”
At about 6 p.m., Cindy did email me a 13-minute MP3 clip of her talking about the arrest Friday. She had been a bridal shower and had a couple of drinks earlier in the evening. She didn’t say what she drank or when. She said close to midnight, she drove three of her girlfriends to their cars. A cop pulled her over for not coming to a complete stop at a stop sign and asked her to take a few sobriety tests including “follow the finger” and “walk in a straight line.” She felt she did fine on those. When he asked her to take a breathalyzer, she refused. “All I’ve ever heard is if you are ever asked to take a breathalizyer test to politely refuse,” she said.
He proceeded to arrest her on suspicion of DUI, handcuff her, place her in the car and sent her to the Atlanta City Detention Center. “I was stunned. Stunned!” she said. “I was a complete mess… it was humiliating. I was sobbing!” She felt she was not intoxicated and in fact, her three friends for preventative purposes, took the breathalyzer tests and passed.
She spent several hours at the detention center getting frisked, having her license taken away and getting a mug shot taken. “It felt like you were in a movie,” she said. “The main room looks like a DMV. You’re sitting with strangers from all walks of life. You’re frightened. There’s no one there to make you feel better.” Her husband Aaron picked her up and she appeared at municipal court that morning to get a court date, which is sometime in November.
“I knew that I was perfectly fine,” she told the listeners. “I wouldn’t do that to anybody else. I wouldn’t do that to my friends or myself or my famly. I’m not a dumb girl.”
Earlier in the day, I was having trouble tracking down info about Cindy’s arrest from the legal authorities until someone below noted that perhaps she was using her married name. She was. It’s Cynthia Glocker. I asked the public information officer at the Atlanta City Detention Center and she found some skeletal information about the arrest. She was booked at 12:52 a.m. October 6 for failure to stop at a stop sign and DUI. She was picked up by the Georgia State Patrol. I don’t yet have an exact time or location of the arrest yet but hopefully the GSP can get that. She was bonded for $1,100 and released.
Based on the sketchy details I was able to provide George Stein, the well-known DUI lawyer who is heard every Friday on 96rock’s Regular Guys, the fact she turned down the breathalyzer is not a bad thing. He’s skeptical of the reliability of the on-site breathalizers.. He also isn’t a big fan of the sobriety tests. “They’re designed for people to fail,” he said. Good news for Cindy: the City of Atlanta has reasonable prosecutors, he said, who will take circumstances into account. From what I can tell, this is Cindy’s first situation like this so they leniency, he said, is possible. That means no DUI conviction on the record, no license suspension, a fine and community service.
I’m trying to get someone at the Atlanta Police Department to give me more info on DUI procedures since it’s something I’m not familiar with.

Not much of a contrast - Cindy pretty much denied any wrong doing herself, with lots of a**kissing support from Ray. The dumb broad actually said that she’s “always heard that your’re supposed to kindly decline when asked to submit to a breathalyzer”. Yeah, I’ve heard that too - you refuse when you know you’re gonna be busted!
From the tone of her voice, you could tell she was very reluctant to give her on-air admission… it had big time, corporate laywer SPIN written all over it!
Wouldn’t expect anything sincere or original from these two whiney little b*tches anyway. Case in point, HOT GAY JOE is a blatant ripoff of the Queen formerly of 99x and davefm.

Come on guys. Give her break! I’m sure a lot of the people that posted on here have gone out with friends and had drinks as well. You just didn’t get caught like she did. Of course, no one knows what her blood alcohol level was and basically is no one’s business. She was up front about being pulled over for a DUI and i’m sure it will never happen again. Case in point, she learned a valuable lesson!
I agree with LawDog as well about the “innocent until proven guilty”. Basically everyone has already condemned her and she hasn’t even gone to trial.
I moved to the area in April and love to listen to Ray and Cindy in the afternoons. There are times that I laugh all the way home in the afternoons. They talk about real issues that most of us want to hear. If you don’t like their show (which some of you don’t based on your comments) turn the station and quit fussing and saying degrading things about it.
Everyone is entitled to their opinion but most people just keep their opinions to themselves, which is where they should stay!!!!!!

Gttim is correct. Refusal to take the state administered breath test is an automatic suspension. Local prosecutors have no control over the suspension. Ga Dept Public Safety controls suspensions by Ga Law. She should have taken the test and then she would have the right to request a blood test of her own choosing (at her expense). But you must take the state test first. What is that adjective they use with blonde?

I’m more surprised by the latter. I used to listen to them for the traffic reports on the way to work. Since *368, I enjoy the peace and quiet. Why would anyone want to listen to her, Vicki “Dumber” Lock, or any of the other whiny voices trying to sell Verizon and Sona Hair Removal? If Tom Sullivan or Steve McCoy ever moved stations, I might listen to them and turn the unused radio back on.

Its unfortunate it happened and that its posted in the paper, but when your a public figure this type of stuff goes along with the territory.
By no means would I ever condone drinking and driving and unfortunately too many lives are lost by those who get behind the wheel when they shouldn’t. But they need to figure out a new system that better determines when your truly impaired and when your not. One cocktail may impact one person whereas it won’t with another. I can tell you being a pretty big guy one beer does not affect me in the slightest, but if I blew shortly thereafter I’m sure I wouldn’t pass a breathalyzer test and to me that would be wrong.
But I do think a lot of people get behind the wheel completely loaded when they shouldn’t so ultimately its a tough call as to what to do with the system.

Funny how George Stein says refusing the Intox test isn’t bad. Apparently the outdated technology is good enough to force a fair number of his clients into entering guilty pleas. Check the court records on pleas vs. trials and that will tell the true story of what Mr. Stein thinks about the Intox. The technology works just fine…and will continue to do so until Mr. Stein and others can plant enough seeds in the minds of potential jurors that it does NOT work. Consider the source.

Why is the Cindy and Ray show always talking about all of the party places and the adult beverages to drink? Obviously they are not advocating drinking and driving BUT they sure do advocate “adult” beverages on their talk. Maybe the show might change their toon. You can’t be “made” to take a blood or breath test. You are informed of your rights via an Implied Consent card that an officer will read you at the scene of the stop. You are told that Georgia Law requires a test of your blood, breath or other bodily substances and that if you REFUSE, then your license could be suspended for one year. An officer can’t just force a test, but the driver should know that if they refuse, they WILL lose their license. In the long run, it is FAR better to take whatever test you are asked for and then IMMEDIATELY ask for your own test at a nearby hospital. That way, you can be sure the Officer’s test is correct and you can STILL keep your license!

It sounds like she refused the roadside breath test (the Alcosensor), which does not result in an automatic suspension (in fact, the number readout isn’t even admissible in court). We don’t really know, since the article only says she refused a “breathalyzer” test, which is really just a layman’s term for any breath test. If she refused the Intoxilizer test at the station, that is grounds for a suspension.

Bad mouth Cindy all you want, but never speak badly of the Stein. He’s a great attorney. He got a friend of mine off for a possession of alcohol charge when we were in college, and my friend was caught with a cup of beer in his hand. The police didn’t test the cup of liquid, and the Stein called them on it. As for the breathalizer, (unStein related story) I’ve known of two cirumstances where people have gotten off scott-free because they refused the breathalizer. In both situations, there was no license suspension nor was there DUI conviction.

I love listening to Cindy and Ray; they’re real people with real issues. I didn’t listen to the broadcast on Friday, but I can guarantee you she’s only complaining as much as anyone else who only had a few drinks before leaving. No, I’m not advocating drinking and driving, but I’m sure she knew her capability of driving and trusted herself to be able to drive unimpaired. We ALL slide through stop signs with or without alcohol…
I think it’s so silly you are all flipping out over this as if it’s really that big of a deal. At least she was honest about having a couple of drinks instead of trying to lie to the cops. Hypocrit, no. Human, yes.

Sobriety test designed to fail??? That makes no sense at all. Cover up if you want to! I had a perfect record too. NO law have I ever broken. I got a dui in 2004. Leniency was not an option. State of Georgia first time dui offenders get the minimum. Dui conviction, drivers license suspended, dui school, community service, and fine. Be responsible for your on actions!! If you did the crime, then pay the consequences!! PERIOD! Anything else is $%#@!!!

I heard the broadcast, she wasn’t clear as to how many drinks she had, a couple a few?? She did say her friends in the car all took the test after her arrest to see if they were clear to drive home. All 3 passed. Doesn’t sound like she took the test at the station, she didn’t mention it. Her and Ray went on and on about how they were told to NEVER take the test. Where they told about the consequences if you don’t take the test? Bottom line if she thought she was sober enough to drive, she would have taken the test and passed.

notastar94fan…I pulled up the Fulton Co. Sheriff’s page and pulled up arrests for 10/6 and 10/5…no luck…no listing for any female named Simmons and no DUI listings that match her. Was she pulled over by the State Patrol?? I give up…I’ll let some other Cybersleuth find her mug shot.

I used George Stein in 96 after being popped by brand new Suawanee cop who followed me out of the parking lot of the Holiday Inn and lit me up before I got over the bridge, could not afford him so he kept changing court dates until I had paid him off. He believed I was innocent. He let me make payments I was not guilty they kept making me blow into the same straw until they got the results they wanted. I was found not guilty. My record since then…not even a parking ticket. According to my kid,(a cop) 1. no probable cause. 2. You only blow once then new straw. Total setup.

What is a total setup is the bull** that “cat” is posting. Stein is an overpriced blowhard is shrinks away from a trial whenever he can. And using a “straw”? Listen, nimrod, you don’t switch mouthpieces during a breath test. The machine cleans itself and the mouthpiece keeps residual mouth alcohol out of the system. That’s why it’s CURVED at two 180 degree angles and is made of hard plastic (NOT a “straw”). Maybe you were so drunk when you took your test you can’t remember…or is “cat” really George Stein?

How many times have we all been out somewhere and had 1 maybe 2 drinks and we are not falling around drunk…. this could happend to anyone… I think the cops are getting to be pretty harassing around here, I was pulled over in buckhead last week and I was not doing anything wrong and the cop was just trying to see if i had been drinking, I am not for people driving around drunk, but to pull people over for no reason,follow them out of a bar is getting to be a little to much.

Either you are all jealous because this chick has a better job than you or your’re mad cus you aren’t getting any. Do you not have wives? mothers? girlfriends? daughters? My wife listens to her show and I happened to be in the car with her that day. I am not a big fan of their show but if you heard the story when she talked about it, you would have probably heard what actually happened. I say that takes guts to even talk about it. I have never seen such a bunch of immature, whiny and rude adults as I have witnessed on here. What do her looks, brain or private parts have anything to do with anything. Pathetic.

Call me crazy, but I think Cindy looks better in her mug shot. That publicity photo reminds me of Jack Nicholson in “The Shining.” It’s almost like she’s saying “Of course I don’t have an axe behind my back. Why do you ask?”

i happened to hear cindy during the show on thursday say she was going out “for cocktails” and didn’t like the way that sounded on STAR94. My young children listen to STAR94 and i don’t think it sounds good promoting the fact that she likes to have a few cocktails. she looks like she’s had more than a few cocktails in her mig shot. she looks rough. i don’t wish her any bad luck but she flaunts around the fact that she’s going out drinking….don’t care for her anymore. poor baby.
